AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
;EZONING A PORTION OF LOT ONE (1), TRACT "A ", U. S. SURVEY NO.
3465 FROM SERVICE RECREATIONAL TO UNCLASSIFIED
WHEREAS, AS 07.1 15.340 empowers the Borough to enact
a Zoning Ordinance and provide for its administration,
enforcement and amendment, and
WHEREAS, the Kodiak Island Borough has pursuant
thereto adopted Chapter 5 of its Code of Ordinances and
Resolutions, which provides for planning and zoning provisions
and procedures, and
WHEREAS, according to the comprehensive Planning
and Zoning Map adopted by the Kodiak Island Borough, Lot One
(1), Tract "A ", U. S. Survey No. 3465 has been zoned Service
Recreational, and
WHEREAS, the Kodiak Island Borough Assembly has
declared a portion of said property surplus to the Borough's
needs, and has authorized its sale, and
WHEREAS, a Petition has been received from DUANE
H. FREEMAN stating that he is the owner of Lot Twelve A (12A),
Block Three (3), Island Lake Subdivision, which adjoins Lot
One (1), Tract "A ", U. S. Survey No. 3465, and that he presently
has situated on his property a two- bedroom panabode and has
requested and petitioned the Kodiak Island Borough to sell to
him twenty (20) feet of Lot One (1), Tract "A ", U. S. Survey
No. 3465 in order to clear up an encroachment of his present
building on said property, and in order to build two (2) more
bedrooms onto his present home, and
WHEREAS, pursuant to said Petition the Kodiak
Island Borough adopted Resolution No. 72 -37 -R declaring that
portion of Lot One (1), Tract "A ", U. S. Survey No. 3465

Surplus to the Borough's needs, and
WHEREAS, the Kodiak Island Borough has entered into
a five -year lease with the Kodiak Lodge No. 1772 of the BPOE for
all of Tract "A ", Lot One (1), U. S. Survey No. 3465 for use as
Service Recreational, but the above - described portion of said
land is not now being used for said purposes and is surplus to
the Borough's needs, and is a tract of land from which the
Borough is not deriving any revenue, and the Kodiak Lodge No.
1772 of the BPOE has filed a letter of non - objection to the
relinquishment and sale to DUANE FREEMAN of said property, and
said matter having been previously considered by the Borough
Assembly as far back as September 8, 1967, and it having been
determined that the public necessity, convenience and good
zoning practice requires such reclassification.
NOW, THEREFORE, BE IT ORDAINED by the Borough
Assembly of the Kodiak Island Borough known and described as:
That part of Lot One (1), Tract "A ", U. S. Survey
No. 3465 described as beginning at Corner 4,
Tract "A ", U. S. Survey No. 3465; thence S18*13'
W, 20.00 feet along the Easterly boundary of
tract; thence N 71 023' W, 79.11 feet; thence inna
Northwesterly direction 21.50 feet toU. S. Survey
the Northerly boundary of Tract "A ",
No. 3465; thence S 71023' E, 87.00 feet along said
boundary to the point of beginning, containing
1,661 square feet, more or less
Now classified as Service Recreational, be and the
same is hereby reclassified as Unclassified, and that notice of
this Ordinance be given by publication in the Kodiak Mirror
seven (7) days prior to the second reading, and that a public

hearing be held thereon on the date of said second reading and
this Ordinance become effective at the expiration of thirty
(30) days after its passage and approval.
