1972-19 Removing Designation of Burrow Site for Portions of Bells Flats Subdivisioni KODIAK ISLAND BOROUGH ORDINANCE NUMBER 72 -19 -0 I I AN ORDINANCE OF THE BOROUGH ASSEMBLY OF THE KODIAK ISLAND BOROUGH REMOVING THE DESIGNATION OF BURROW SITE FROM i' TWO PORTIONS OF TRACT "A" BELLS FLATS ALASKA SUBDIVISION. WHEREAS, AS 07.15.340 empowers the Borough to enact - a zoning ordinance and provide for its administration, enforcement and amendment, and WHEREAS, the Kodiak Island Borough has pursuant thereto, adopted Chapter 5 of its Code of Ordinances and Resolutions, which provides for planning and zoning provisions and procedures, and WHEREAS, according to the Comprehensive Planning and Zoning Map adopted by the Kodiak Island Borough, as amended by Ordinance No. 69 -30 -0, Tracts "A" and "B" of the Bells Flats Alaska Subdivision were designated burrow sites and zoned "Industrial ", and WHEREAS, a portion of Tract "A" leased to ROYAL LARGE in November, 1971, is designated as a burrow site, but cannot be used as such because the irregular shape would make it impossible to meet the slope grades and other restrictions placed on it by the Burrow Site Ordinance, and WHEREAS, another portion of Tract "A" was deeded to the State of Alaska for construction of a slaughter house to be operated by the Kodiak Stock Growers Association, and is being used as such, and therefore, although an industrial use should not be classified as a burrow site, and the Kodiak Island Planning and Zoning Commission at its meeting of June 21, 1972 having recommended to the Borough Assembly the redesignation of these two tracts, and it appearing to the Assembly that the public necessity, convenience, general welfare and good zoning practice requires that these tracts be redesignated.
