AN ORDINANCE REZONING THAT PORTION OF U. S. SURVEY
N0. 1396 SITUATED ON UE NORTHERLY SIDE OF ML BAY ROAD, KODIAK,
ALASKA, CONTAINING 17.61 ACRES, MORE OR LESS, FROM UNCLASSIFIED
TO R -3
�4I-IEREAS, AS 07.15.340 empowers the Borough to enact
zoning ordinances and provide for their administration, enforce-
ment and amendment, and
WHEREAS, the Kodiak Island Borough has pursuant thereto
adopted Chapter 5 of the Code of Ordinance and Resolutions which
Provides for Planning and Zoning Provisi and Procedures, and
WHEREAS, according to the co rehensive Planning and
Zoning map adopted by the Kodiak Isl d Borough, that portion of
U. S. Survey No. 1396 situated on Northerly side of Mill Bay
Road, Kodiak, Alaska, described

Is presently zoned unclassified, and
WHEREAS, a Petition has been received from S. M.
CORPORATION, BARANOF HEIGHTS, INC. and JOHN A. FRAY, an individual,
stating that they desire to have said land reclassified so that it
may be subdivided into lots and offered for sale to persons wishing
to construct multiple dwelling units, and
WHEREAS, on February 16, 1972, the Kodiak Island Borough
Planning and Zoning Commission reviewed the matter and recommended
the recalssification of this property from Unclassified to R -3, and
it haveing been determdned that public necessity, convenience and
good zoning practice requires such reclassification.
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of
the Kodiak Island Borough that the property known and described as:
That portion of U. S. Survey No. 1396, Kodiak Island
Borough, State of Alaska, described as follows:
Beginning at Corner 2, U. S. Survey 1396; Thence

Boundary of said Survey;

All now classified as Unclassified, be and the same is
hereby reclassified as R -3, and that notice of this Ordinance be
given by publication in the Kodiak Mirror at least seven (7) days
prior to the second reading and that a public hearing be held
thereon on the date of the second reading, and that this Ordinance
become effective at the expiration of thirty (30) days after its
final passage and adoption.
