AN QRDINANCE rezoning Tract "A" of U.S. Survey No. 444

WHEREAS, AS 07.15.340 empowers the Borough to enact
zoning ordinances and provide for their administration, enforce-
ment and amendment, and
WHEREAS, the Kodiak Island Borough as pursuant thereto
adopted Chapter Five of its Code of Ordinances and Resolutions
which provides for planning and zoning provisions and procedures,
and
WHEREAS, according to the comprehensive Planning and
Zoning map adopted by the Kodiak Island Borough, Tract "A" of
U.S. Survey No. 444 has been classified as Service Recreational
or public, and
WHEREAS, a petition has been received from the
corporation of the Catholic Archbishop of Anchorage stating
that it is the owner of Tract "A" of U.S. Survey No. 444 which
land is zoned service recreational or public and which the
petitioner requests to be rezoned as industrial as the same
is adjacent to properties of the Standard oil Company of Calif-
ornia on which are constructed and maintained oil storage tanks
and that this area would be better utilized and served if the
same were classified to reflect the proper use of said land and
WHEREAS, the petition was considered and approved by
the Planning and Zoning Commission on the 13th day of May 1970
and said body has recommended the reclassification of said
property to industrial and there were no objections voiced at
the public hearing held by the Planning and Zoning Commission
on May 13, 1970, and it having been determined that the public
necessity, convenience, and good zoning practice require such
reclassification,

NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough that the property
known and describe
as Tract "A" U.S. Survey No. 444 now classified as service recrea
tional or public be and the same is hereby reclassified as
industrial and that notice,of this Ordinance be given by publica-
tion in the Kodiak Mirror seven (7) days prior to the second
reading and that a public hearing be held thereon on the date
of the second reading and that this Ordinance become effective
at the expiration of thirty (30) days after its adoption.
