ORDINANCE NO. 69 -37 -0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
REZONING LOTS ONE, TWO, AND THREE, BLOCK ONE AND LOTS ONE
THROUGH NINE, BLOCK TWO, U.S. SURVEY NUMBER 3066, SOUTHEAST
ADDITION NUMBER TWO TO THE CITY OF KODIAK, FROM UNCLASSIFIED TO
BUSINESS.
WHEREAS, AS 07.15.340 empowers the Borough to en-
act a zoning ordinance and provide for its administration, en-
forcement and amendment, and
WHEREAS, the Kodiak Island Borough has pursuant
thereto adopted Chapter Five of its Code of Ordinances and Reso-
lutions which provides for planning and zoning provisions and
procedures, and,
WHEREAS, according to the comprehansive planning
and zoning map adopted by the Kodiak Island Borough, Lots One
(1), Two (2), and Three (3) Block One (1) and Lots One (1) through
Nine (9) Block Two (2) of U.S. Survey No. 3066 Southeast Addition
No. Two (2) to the City of Kodiak have been classified as un-
classified and
WHEREAS, a Petition has been received from Robert
Scott and A.J. Cichoski requesting the rezoning of said lots to
business and whereas there are already several business establish-
ments in the area operating under "grandfather rights" and with-
out rezoning they will not be able to expand and
WHEREAS, the Kodiak Island Borough Planning and
Zoning Commission held a public hearing on said Petitions on
December 10, 1969 and thereafter recommended the reclassification,
on the grounds aforesaid and there were no objections voiced at
the public hearing to the reclassification of these lots and it
having been determined that the public necessity, convenience,
general welfare and good zoning practice requires such reclassi-
fication,
NOW, THEREFORE, BE IT ORDAINED by the Borough
Assembly of the Kodiak Island Borough that Lots One (1),
Two (2)

Block Two (2) of U.S. Survey Number 3066 Southeast Addition
Number Two (2) to the City of Kodiak now classified as unclassi-
fied be and the same are hereby reclassified to Business and
that notice of this ordinance be given by publication in the
Kodiak Mirror seven (7) days prior to the second reading and
that a public hearing be held thereon on the date of the second
reading and that this ordinance become effective at the expira-
tion of thirty (30) days after its adoption.
