07/02/2002 RMKODIAK ISLAND BOROUGH Regular Assembly Meeting July 2, 2002 A regular meeting of the Kodiak Island Borough Assembly was held July 2, 2002 in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 7:30 p.m. The invocation was given by Captain Davis of the Salvation Army, followed by the Pledge of Allegiance. There were present: Mayor: Gabrielle LeDoux Assemblymembers: Tom Abell Tuck Bonney Pat Branson Robin Heinrichs comprising a quorum of the Assembly; and Pat Carlson, Manager Judi Nielsen, Borough Clerk Nova Javier, Deputy Clerk APPROVAL OF AGENDA Regular Assembly Meeting July 2, 2002 Greg Razo Wayne Stevens Darlene Turner HEINRICHS, moved to approve seconded by BRANSON the agenda. VOTE ON MOTION TO APPROVE MOTION CARRIED APPROVAL OF MINUTES 1. Kodiak Island Borough Assembly Regular Meetings of June 4 and 16, 2002. BRANSON, seconded by TURNER VOTE ON MOTION TO APPROVE MOTION CARRIED AWARDS AND PRESENTATIONS A. Honorary Citation to Steve Cole The Mayor and Assembly presented an honorary citation to Steve Cole in recognition of his dedicated service and contributions to the Kodiak Island Community since 1995, for organizing, recruiting, volunteering, and garnering participation for the very successful Kodiak Teen Court. Steve Cole accepted the honorary citation and shared the credit to their board of directors and to the young adults involved in the program. Unanimous voice vote moved to approve the minutes as submitted. Unanimous voice vote REGULAR MEETING ROLL CALL APPROVAL OF AGENDA APPROVAL OF MINUTES AWARDS AND PRESENTATIONS HONORARY CITATION TO STEVE COLE Volume XXVII Page 215 CITIZENS COMMENTS Mike Milligan welcomed Steve Kreber back. He appreciated that the Assembly made land available to the public and urged the process to continue to increase the tax base. COMMITTEE REPORTS Jake Ketscher, Planning and Zoning Commissioner said the Commission looked forward to their meeting with the Assembly on August 8. In response to Assemblymember Razo, Mr. Ketscher said new Commissioners had not received formal training or orientation; however, that would be valuable. Assemblymember Razo encouraged the Commissioners to receive training at available seminars. PUBLIC HEARING A. Ordinance No. 2002 -11 Amending Kodiak Island Borough Code of Ordinances Title 7 Elections Chapter 7.50 Absentee Voting section 7.50.010 Eligibility, section 7.50.020 Materials for absentee voting, section 7.50.030 Absentee voting - -In person, section 7.50.040 Absentee voting - -By personal representative, and section 7.50.050 Absentee voting - -By mail. TURNER, moved to adopt seconded by BRANSON Ordinance No. 2002 -11. Clerk Nielsen reported that effective January 1, 2002, Alaska Statutes Title 15 was amended to eliminate absentee voting by personal representative and create special needs voting. Also, Alaska Statutes provided for the submission of absentee ballot requests by electronic transmission as an assistance to absentee voters. Once adopted, the ordinance would be sent to the Department of Justice for preclearance. Mayor LeDoux called for public testimony; hearing and seeing none, she reconvened the regular meeting. There was no discussion by the Assembly. VOTE ON MOTION TO ADOPT Ayes: Abell, Bonney, Branson, Heinrichs, Razo, Stevens, Turner Noes: None Absent: None MOTION CARRIED: Unanimous BOROUGH MANAGER'S REPORT Manager Carlson wished everyone a happy Fourth of July. MESSAGES FROM THE BOROUGH MAYOR In response to Mayor LeDoux, the Assembly authorized her to sign a Salvation Army Kodiak Corps and Community Center's application for a Transitional Housing for Recovering Substance Abusers grant. Regular Assembly Meeting July 2, 2002 CITIZENS' COMMENTS COMMITTEE REPORTS PUBLIC HEARING ORDINANCE NO. 2002 -11 BOROUGH MANAGER'S REPORT MESSAGES FROM THE BOROUGH MAYOR Volume XXVII Page 216 In response to Assemblymember Stevens, she said she decided not to attend the fish conference in Dutch Harbor because she had a death in the family and she felt the Borough did not have position on crab rationalization. She deferred to Manager Carlson for a report. Manager Carlson said crab rationalization discussions were being held in Washington, D.C. and he was uncertain of what the results would be. Mayor LeDoux was disappointed that Governor Knowles vetoed the budget and Larsen Bay's request for mosquito magnets was denied. She wanted to see discussions about this at an Assembly work session. She was appalled that the United States Supreme Court found the words "under God" in the Pledge of Allegiance unconstitutional. She wished everyone a happy Fourth of July. UNFINISHED BUSINESS None. NEW BUSINESS A. CONTRACTS RAZO, moved to award Contract seconded by HEINRICHS No. 2002 -10 to IRS Environmental of Anchorage in an amount not to exceed $34,890. Manager Carlson reported that four bids were received and the low bidder was IRS Environmental of Anchorage. Reference checks reflect that the project manager had substantial experience with this type of project. VOTE ON MOTION TO APPROVE Ayes: Noes: 1. Contract No. 2002 -10 High School Asbestos Tile Abatement and Carpet Removal. None MOTION CARRIED: Unanimous Bonney, Branson, Heinrichs, Razo, Stevens, Turner, Abell 2. Contract No. 2002 -11 High School Carpet Installation. RAZO, moved to award Contract seconded by BRANSON No. 2002 -11 to Designer Carpets of Anchorage in an amount not to exceed $47,031. Manager Carlson reported that one bid was submitted for this project and he anticipated additional work to be funded through the change order process. In response to Assemblymember Heinrichs, Manager Carlson noted that labor and materials were included in the bid. Assemblymember Razo saw this as another example of the good working relationship between the Borough and the School District. Regular Assembly Meeting July 2, 2002 UNFINISHED BUSINESS NEW BUSINESS CONTRACTS CONTRACT NO. 2002 -10 CONTRACT NO. 2002 -11 Volume XXVII Page 217 Manager Carlson said this project also included painting and rearranging the senior hall. Contract No. 2002 -12 Providence Kodiak Island Medical Center Roof Repair. STEVENS, moved to award Contract seconded by BRANSON No. 2002 -12 to Clarion Company of Kodiak in the amount of $48,960 with change orders for unit cost items estimated at approximately $15,000. Manager Carlson said one bid was submitted and the full scope of the project would not be known until the roof was removed. In response to Assemblymember Razo, Manager Carlson said Borough project Manager Jerry Bowen would work closely with Clarion Company when he returned from medical leave. Resolution No. 2002 -22 Granting a Request for Use of Certain Borough Land to the University of Alaska Fairbanks for the purpose of Conducting Ecological Research on Marine Birds. BRANSON, moved to adopt seconded by HEINRICHS Resolution No. 2002 -22. Manager Carlson said the University of Alaska Fairbanks sought to obtain authorization to establish temporary radio receiving stations on Borough land to track the movement of radio - tagged Kittiwakes. CITIZENS' COMMENTS Captain Dave Davis, in celebration of freedom, wished everyone a happy and safe Fourth of July. In response to a phone call of Wally Johnson, Manager Carlson said the Borough had over sixteen acres of roofing to be maintained and most of the work was roof repairs to extend the useful life rather than re -roof at ten times the cost. It was imperative to pay constant attention because of the inclement weather and the age of the structures. Wil Milam phoned to wish Assemblymember Stevens a happy birthday. ASSEMBLYMEMBER COMMENTS Assemblymember Razo wished Assemblymember Stevens a happy birthday. He noted that everyone should celebrate and place a high value on freedom especially after the September 11 tragedy. He wished everyone a happy Fourth of July. Assemblymember Abell said Kodiak was a fortunate community. He congratulated Steve Cole for his achievements. He encouraged input from the community regarding concerns about the proper utilization of recreation areas in the Borough. He said the ATV Adhoc Committee was a public committee and all meetings were open to the public. Assemblymember Turner wished everyone a happy and safe Fourth of July. She felt everyone should reflect on the freedom that we, as Americans, enjoy. She wished Assemblymember Stevens a happy birthday. She congratulated Steve Cole on the honorary citation Assemblymember Stevens wished Assemblymember Branson a happy birthday. He welcomed Steve Kreber back. He announced that a welcoming reception for the NOAA Ship's crew would be held on Wednesday, from 6:00 p.m. to 8:00 p.m. at the Fisheries Research Center. Assemblymember Bonney congratulated Steve Cole for his achievements. He noted the ludicrous statements published in the newspaper about the ATV Adhoc Committee. He felt people should be involved if they want their voices heard. He said the committee worked hard reviewing all sides. Assemblymember Heinrichs wished Assemblymember Stevens a happy birthday. He said it was good to see Steve Kreber back behind the camera. Assemblymember Branson congratulated Steve Cole by saying that he was a role model of integrity and volunteerism. She wished everyone a happy Fourth of July and wished Assemblymember Stevens a happy birthday. Mayor LeDoux announced that the Assembly would meet in a special meeting immediately following the regular meeting. The Assembly would meet in a work session Thursday, July 11 at 7:30 p.m. in the Borough Conference Room; a Joint Regular Assembly Meeting July 2, 2002 OTHER ITEMS CITIZENS' COMMENTS ASSEMBLYMEMBER COMMENTS Volume XXVII Page 219 Assembly /City Council work session Tuesday, July 16 at 7:30 p.m. in the Borough conference room; and a regular meeting on Thursday, July 18 at 7:30 p.m. in the assembly chambers. She announced that the Kodiak Island Borough offices would be closed Thursday, July 4, 2002 in observance of the Fourth of July holiday. She wished everyone a happy Fourth of July.
