03/25/2004 SMA special meeting of the Kodiak Island Borough Assembly was held March 25, 2004 in the Kodiak Island Borough Conference Room at 710 Mill Bay Road. The meeting was called to order at 8:34 p.m. Present were Mayor LeDoux, Assemblymembers Tom Abell, Tuck Bonney, Pat Branson, Robin Heinrichs, Cecil Ranney, Wayne Stevens, and Nancy Wells. Staff present were Manager Pat Carlson, Clerk Judi Nielsen, and Deputy Clerk Nova Javier. CONSIDERATION OF MATTERS FOR THE SPECIAL MEETING A. Resolution No. 2004 -09A Amending Resolution No. 2004 -09 Establishing Citizens Board of Equalization Dates for the Year 2004. HEINRICHS moved to adopt Resolution No. 2004 -09A, seconded by BRANSON Manager Carlson said this would correct the dates on Resolution No. 2004 -09. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Abell, Bonney, Branson, Heinrichs, Ranney, Stevens, Wells B. Ordinance No. 2004 -02 Amending Kodiak Island Borough Code of Ordinances Title 3 Revenue and Finance Chapter 3.01 Fiscal Policy Section 3.01.030 Debt Policies Chapter 3.12 Appropriation and Levy Section 3.12.010 Ordinance Enactment Section 3.12.030 Acceptance and Appropriation of Grant Funds and Chapter 3.16 Contract, Purchase, Sale, and Transfer Procedures Section 3.16.020 Limitation on Manager's Authority Section 3.16.040 Advertising Section 3.16.050 Processing. This ordinance was postponed from the March 18 regular meeting. The motion before the Assembly was to adopt Ordinance No. 2004 -02. Assemblymember Stevens said a section was ordinance and asked for postponement. STEVENS moved to postpone Ordinance No. 2004 seconded by ABELL ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Bonney, Branson, Heinrichs, Ranney, Stevens, Wells, Abell C. Contract No. 2004 -09A Amending Contract No. 2004 -09 Purchase of Used Storage Containers for Akhiok, Karluk, Larsen Bay, Old Harbor, Ouzinkie, and Port Lions to Collect and Store Household Hazardous Waste. HEINRICHS moved to amend Contract No. 2004 -09 by approving Contract No. 2004 -09A with Samson Tug & Barge in an amount not to exceed $23,100, seconded by BRANSON Manager Carlson said this contract went out to bid and asked the Assembly to award the contract to Samson Tug & Barge. Contract No. 2004 -16 Removal of Household Hazardous Waste From the Borough in Conjunction with Kodiak Spring Clean -up Day. ABELL moved to approve Contract No. 2004 -16 with Philip Services Corporation in an amount not to exceed $35,000, seconded by STEVENS Manager Carlson said this was a time and materials contract to remove hazardous materials generated from metals recycling at the Baler /Landfill. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Heinrichs, Ranney, Stevens, Wells, Abell, Bonney, Branson At 8:43 p.m., Mayor LeDoux called for a ten minute recess. E. EXECUTIVE SESSION - Borough Manager's Review BONNEY moved to convene into executive session to discuss and review the Borough Manager's performance and invite all Assemblymembrs and the Manager to participate SECONDED BY Branson ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Ranney, Stevens, Wells, Abell, Bonney, Branson, Heinrichs After the vote, Mayor LeDoux passed the gavel to Deputy Mayor Bonney. Upon returning from the executive session, Deputy Mayor Bonney reconvenes the special meeting and announces there is no action to be taken as a result of the executive session.
