04/20/2000 RMA regular meeting of the Kodiak Island Borough Assembly was held April 20, 2000 in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 7:30 p.m. There were present: ROLL CALL Mayor: Gary L. Mayor Stevens proclaimed April 30 - May 6, 2000 Municipal Clerks Week in honor of Kodiak Island Borough Clerk, Judi Nielsen; Deputy Clerk, Patti Kirkpatrick; and Assistant Clerk, Cathy Fagan; as well as the following Kodiak Island Municipal Clerks: City of Kodiak Clerk, Debra Marlar and Deputy Clerk, Barbara Zharoff; City of Akhiok Clerk, Kara Simeonoff; City of Larsen Bay Clerk, Tammy Aga; City of Old Harbor Clerk, Jonetta Cratty; City of Ouzinkie Clerk, Debra Garner; and City of Port Lions Clerk, Evelyn Mullan, in appreciation of the vital services municipal clerks perform and their exemplary dedication to the communities they represent. Mayor Stevens proclaimed May 2000 Litter Prevention and Cleanup Month urging all residents to participate in the Kodiak community Litter Cleanup Day on Saturday, May 6, 2000 and to resolve to help keep Kodiak Island clean and beautiful throughout the year. Manager Jensen presented the Employee of the Quarter Award to Marian Royal', accountant in the Finance Department. Jack McFarland urged the Assembly to support Resolution No. 2000 -16 Municipal Dividend payment program. Chuck McGee, Census Bureau representative, thanked the Assembly for proclaiming April 1 Census Day. His AWARDS AND PRESENTATIONS PROCLAMATIONS NATIONAL TAKE YOUR DAUGHTERS TO WORK DAY MUNICIPAL CLERKS WEEK LITTER PREVENTION AND CLEANUP MONTH EMPLOYEE OF THE QUARTER CITIZENS' COMMENTS COMMITTEE REPORTS Volume XXVI Page 51 office was conducting the Census in Alaska and there was concern about the low return rates statewide. The Bureau would not mail forms to post office boxes because that did not correlate with the number of residents in a home. He said door to door census workers would begin in Kodiak on April 27 with a completion date no later than mid -June. Mayor Stevens felt this was valuable to the community and it was important to complete and return census forms. Assemblymembers Branson and Abell said they received the census forms at their post office box. Mr. McGee said they were working through the process and could foresee changes for the 2010 census. He encouraged residents with questions to phone his office collect at (907) 271 -1300. Assemblymember Turner was concerned that no one in her neighborhood had received a census form. She looked forward to meeting the census workers. In response to Mayor Stevens, Mr. McGee said the thirty local census workers would begin training on April 24. PUBLIC HEARING A. Ordinance No. 2000 -02 Amending Kodiak Island Borough Code of Ordinances Title 3 Revenue and Finance Chapter 3.16 Contract, Purchase, Sale, and Transfer Procedures Section 3.16.070 Exceptions to Bidding Requirements to Provide for Donated Street Improvements. TURNER, moved to adopt seconded by BRANSON Ordinance No. 2000 -02. Manager Jensen said code currently required the creation of assessment districts to provide street and other improvements, and that required the bid process. He said the amendment would establish a procedure for the Borough to accept donated street and other improvements after the filing of a plat. Mayor Stevens called for public testimony; hearing and seeing none, he reconvened the regular meeting. Assemblymember Abell felt this would benefit the community and the Borough. VOTE ON MOTION TO ADOPT Ayes: Noes: MOTION CARRIED BOROUGH MANAGER'S REPORT Regular Assembly Meeting April 20, 2000 Abell, Arndt, Bonney, Branson, Heinrichs, Spalinger, Turner None Unanimous Manager Jensen met with Congressman Don Young's staff members Chad Padgett and Doug Salik who expressed concern with the effect of the Stellar sea lion issue on the community. He received a request for assistance with economic development from the Mayor of Port Lions. He noted Congressman Young was also interested in the economic development in Port Lions. Manager Jensen said he looked forward to traveling to Akhiok on Friday, May 21. MANAGER'S REPORT MESSAGES FROM MESSAGES FROM THE BOROUGH MAYOR THE MAYOR Mayor Stevens and Assemblymember Branson participated in a teleconference on the proposed tax cap initiative that would be on the November 7 ballot. He was concerned with the potential affects of a tax cap and asked the Assembly to consider a resolution relating the concerns. UNFINISHED UNFINISHED BUSINESS BUSINESS None. NEW BUSINESS NEW BUSINESS CONTRACTS CONTRACTS 1. Contract No. 2000 -04 Project Management CONTRACT NO. Services for Implementation of the Exxon 2000 -04 Valdez Oil Spill Trustee Council Funded Kodiak Island Borough Waste Management Plan. Volume XXVI Page 53 BRANSON, seconded by HEINRICHS Manager Jensen said the project was funded by grants. Four key coordinators had worked on the project since its inception and that created delays. He recommended approving the contract with KMT Planning of Kodiak. Assemblymember Heinrichs said the villages relied upon the plan for waste metals removal. He was pleased to have someone willing to take on the task. Assemblymember Arndt thought to hire an employee who could also work on other in -house projects. He did not feel there was sufficient work to warrant a forty hour week. Assemblymembers Branson and Turner supported the contract, noting it was long awaited and much needed. VOTE ON MOTION TO APPROVE Ayes: Noes: None MOTION CARRIED Unanimous HEINRICHS, seconded by BONNEY moved to approve Contract No. 2000 -04 with KMT Planning of Kodiak in an amount not to exceed $162,000. Arndt, Bonney, Branson, Heinrichs, Spalinger, Turner, Abell 2. Contract No. 2000 -05 Professional Legal Services for Litigation in the Matter of Doe vs. the Kodiak Island Borough. Regular Assembly Meeting April 20, 2000 moved to approve Contract No. 2000 -05 with Gilmore and Doherty, Attorneys at Law, of Anchorage. Manager Jensen said this regained professional legal services in a case that involved a former resident in Borough provided housing. He said the court proceedings were scheduled in late summer or early fall. Resolution No. 95 -OlE Amending Resolution RESOLUTION No. 95 -01 Adopting a Records Retention NO. 95 -OlE Schedule and Central Filing System to Reflect Amendments to Provide for the Change to a Manager Plan of Government. Presented for consideration was Resolution No. 95 -OlE that, if adopted, amended the Records Retention Schedule and Central Filing System to reflect amendments to provide for the change to a manager plan of government. Resolution No. 95 -OlE was adopted under "Consent Agenda ". 2. Resolution No. 2000 -14 Authorizing the Records Manager to Dispose of Certain Borough Records. Presented for consideration was Resolution No. 2000- 14, that if adopted, authorized the records manager to dispose of certain Borough records. Resolution No. 2000 -14 was adopted under "Consent Agenda ". 3. Resolution No. 99 -10B Amending Resolution RESOLUTION No. 99 -10 Establishing Fees of the Kodiak NO. 99 -10B Island Borough to Waiver Fees of Disposal of Junk Vehicles During Spring Clean -Up. Presented for consideration was Resolution No. 99 -10B that, if adopted, established the fees of the Kodiak Island Borough to waiver fees for junk removal during spring clean up 2000. Resolution No. 99 -10B was adopted under "Consent Agenda ". Regular Assembly Meeting April 20, 2000 RESOLUTION NO. 2000 -14 Volume XXVI Page 55 4. Resolution No. 2000 -16 Urging the Governor RESOLUTION and State Legislature to Establish a NO. 2000 -16 Municipal Dividend Payment Program. BONNEY, moved to adopt Resolution seconded by BRANSON No. 2000 -16. Manager Jensen said this was a result of cuts to municipal assistance and revenue sharing and the need for long -term solutions to the need to increase local property taxes. Assemblymember Arndt felt this would impact the Permanent Dividend Fund (PFD). He wanted the state to prepare a solid, long -term plan for using a portion of PFD earnings. Assemblymember Bonney concurred, noting that voters spoke against using PFD earnings last September. He wanted the state to provide a clear plan for long- term funding. Mayor Stevens said the Municipal Dividend Payment Program (MDPP) would be used for essential services in each Alaska municipality and urged the Assembly to adopt the resolution. Assemblymember Abell opposed the resolution and wanted to see a solid, long -term plan issued by the state. Marie Chandler phoned in to ask for a better system for calling in garbage pickups. Assemblymember Turner supported the resolution, noting that the state was reviewing a long -term plan. Assemblymember Spalinger felt the state was cost shifting and was opposed to using PFD earnings. Assemblymember Branson felt this would ensure that all municipalities would receive funds for non- profits, police, and other essential services. Assemblymember Heinrichs felt the resolution was a step toward stabilizing state funding. Mayor Stevens said the MDPP was the first long -term plan from the legislature that made sense and would not affect PFD earnings. He felt the legislature would be left with no option but to introduce a state Regular Assembly Meeting April 20, 2000 Volume XXVI Page 56 income tax. He said the Alaska Municipal League asked for support from municipalities. Assemblymember Bonney supported the voters decision on use of the PFD earnings. ORDINANCE FOR INTRODUCTION TURNER, seconded by BRANSON Manager Jensen said the Borough Code limited the Manager's purchasing authority at $5,000 on all purchases. He said this created delays in funding and additional work for the manager, assembly, and Borough staff. He recommended an increase of purchasing authority to $15,000. CITIZENS' CITIZENS' COMMENTS COMMENTS Marie Chandler phoned to say that if the census count was not correct the count could be challenged. Charlie Davidson phoned to encourage the Assembly to reconsider their vote on Resolution No. 2000 -16. He said essential services like police and schools were not small matters. He favored unification. Mr. Glamann phoned to urge the Assembly to reconsider their vote on Resolution No. 2000 -16. He felt the MDPP had merit and would benefit the community. ASSEMBLYMEMBER COMMENTS ASSEMBLYMEMBER COMMENTS Assemblymember Bonney wanted the state to prepare the plan or essential services to the community would be lost. Assemblymember Branson congratulated Employee of the Quarter, Marian Royall. She appreciated her involvement in the Arts Council. Assemblymember Arndt felt there were special meetings held on issues that could have been presented at a regular meeting. He wanted to review the tax cap issue carefully as it appeared that residences could not be reassessed. He supported the tax cap initiative. Assemblymember Heinrichs congratulated and thanked Marian Royall as a key player in the Finance Department and for her commitment to the Borough. Assemblymember Heinrichs felt long -term solutions were needed to fund the Borough and school district budgets. He was pleased with the community interest in the budget process. Assemblymember Turner also congratulated Marian Royall. She reminded the community that April 27 was National Take Your Daughter to Work Day. She thanked Mr. Davidson and Mr. Glamann for their comments and noted the importance of leadership. Regular Assembly Meeting April 20, 2000 Volume XXVI Page 58 Assemblymember Abell saw reduced communication since annexation failed. He wanted to discuss consolidation of the City and Borough governments. Mayor Stevens announced that members of the Assembly would travel to Akhiok on Friday, April 21. Members of the Assembly and School Board would meet on Saturday, April 22 at 11:00 a.m. at North Star Elementary School. The Assembly would meet in a work session on Thursday, April 27 at 7:30 p.m. in the Borough conference room and a regular meeting on Thursday, May 4 at 7:30 p.m. in the assembly chambers. In response to Assemblymember Arndt, Manager Jensen said the Borough budget would be presented to the Assembly at the April 27 work session. Assemblymember Arndt did not feel that thirty days was adequate to review the school district and Borough budgets.
