04/13/2000 SMA special meeting of the Kodiak Island Borough Assembly was held April 13, 2000 in the conference room of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 9:02 p.m. There were present: ROLL CALL Mayor: Gary L. Stevens Assemblymembers: Tom Abell Scott Arndt Tuck Bonney Absent: Robin Heinrichs comprising a quorum of the Assembly; and Dave Jensen, Manager Judi Nielsen, Borough Clerk Patti Kirkpatrick, Deputy Clerk Cathy Fagan, Assistant Clerk Assemblymember Heinrichs was out and asked to be excused. BRANSON, seconded by TURNER VOTE ON MOTION TO EXCUSE A. Professional Legal Services for Litigation in PROFESSIONAL the Matter of Doe vs. The Kodiak Island Borough. MOTION CARRIED Unanimous voice vote moved to approve payment to Gilmore & Doherty, Attorneys at Law, for professional legal services for litigation in the SPECIAL MEETING Volume XXVI Page 47 Manager Jensen stressed the confidentiality of the case that, when the incident occurred, involved a minor. He said the legal services were rendered and the bill should be paid. Mayor Stevens noted that the confidential information was available to the Assembly in the Manager's office. At the request of the Assembly, Manager Jensen said he would work to obtain a contract with the law firm. VOTE ON MOTION TO APPROVE Ayes: Noes: None Absent: Heinrichs MOTION CARRIED Unanimous BRANSON, seconded by TURNER matter of Doe vs. the Kodiak Island Borough in an amount not to exceed $15,003.03. Abell, Arndt, Bonney, Branson, Spalinger, Turner B. Special Assessment with the City of Kodiak for SPECIAL Property Located at the Corner of Woody Way Loop ASSESSMENT and Rezanof Drive. moved to approve payment of the special assessment to the City of Kodiak for property located at the corner of Woody Way Loop and Rezanof Drive in an amount not to exceed $38,991.97. Manager Jensen wanted to pay the assessment in full as the interest charge was approximately $2,000 per year. Assemblymember Arndt was concerned that funds were not set aside and a budget adjustment was needed.
