RESOLUTION NO. 83 -140 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY TO WITHDRAW
AN APPEAL RELATING TO THE FORMER SCHOOL SITE IN AKHIOK.
WHEREAS, the Bureau of Indian Affairs' school site and facilities
located on Lot 1, Block 4, USS 4926 in the City of Akhiok was still
withdrawn by Executive Order 1194 dating back to 1910 at the time the
Alaska Native Claims Settlement Act of December 17, 1971 became law; and
WHEREAS, a contract agreement between the Bureau of Indian Affairs
and the State of Alaska to transfer the school site with facilities to the
State never took place because of Secretary of Interior Udall's land freeze;
and
WHEREAS, the Alaska Native Claims Settlement Act revoked all
Public Land Orders and Executive Orders benefiting Alaska Natives to allow for .
those lands to be conveyed to the Natives; and
WHEREAS, the Kodiak Island Borough entered an appeal on December 16,
1977 to the Alaska Native Claims Appeal Board (now dissolved and jurisdiction
transferred to the Interior Board of Land Appeals) to claim Lot 1, Block 4,
USS 4926, the school site, be transferred to the Kodiak Island Borough
instead of the Natives of Akhiok; and
WHEREAS, the appeal was eventually going to result in a side

agreement for the Natives of Akhiok to convey the school site under Section
14 (C) (3) of the Alaska Native Claims Settlement Act. This appeal has
I lingered in a suspense category because an untold number of delays and
happenings; and
WHEREAS, a new school has been built on other land in the City
rendering the former site surplus to the Kodiak Island Borough's needs except
for providing teacher housing which is presently being maintained by the
Kodiak Island Borough School District.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
Assembly directs its counsel to withdraw its appeal identified as
IBLA #82 -1115 (ANCAB VLS 77 -14) immediately.
BE IT FURTHER RESOLVED that the Kodiak Isiaiid Borough School District
look to a Native corporate entity that will receive the subject lands, or to
other facilities, for renting or leasing the necessary teacher housing.
