1983-131 Supporting Modification Of The Lease Between The Borough And Timberline, Incorporated.1 0 1 i 1 15 5 KODIAK ISLAND BOROUGH RESOLUTION NO. 83 -131 -R A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY SUPPORTING MODIFICATION OF THE LEASE BETWEEN THE BOROUGH AND TIMBERLINE, INCORPORATED. WHEREAS, the Kodiak Island Borough has a lease with Timberline, Incorporated for a portion of ADL 44355, known as the sawmill lease site; and WHEREAS, the Lease is in effect until October 7, 1986; and WHEREAS, Timberline, Incorporated has submitted a request to modify the eastern boundary of the leased area (without a change in the total acreage of the leased area) and a request to add an additional access road into the site; and WHEREAS, Section 25 of the lease states that "modifications of the lease shall not be binding upon either of the parties unless reduced to writing and signed by both the Lessor and Lessee;" and WHEREAS, the Kodiak Island Borough Planning and Zoning commission has considered Timberline, Incorporated's requests to modify the lease, has conducted an advertised public hearing on the requests, and has made a recommendation to the Assembly regarding the requests. NOW THEREFORE BE IT RESOLVED that the Kodiak Island Borough Assembly supports Timberline, Incorporated's request to modify the eastern boundary of the leased area with no increase in the acreage of the sawmill lease site (per the map submitted by the lessee). BE IT FURTHER RESOLVED by the Kodiak Island Borough Assembly that: 1) the greenbelt (100 -foot buffer zone) around the lease site will be maintained per Section 4 of the lease; and 2) One additional access road will be permitted to the leased site per Timberline's proposal; and 3) Timberline, Incorporated shall assume all expenses incurred as a result of the boundary change; and 4) the Assembly considers the boundary modification justification for a rent increase of $ 93.34 per month.
