RESOLUTION NUMBER 68 -23 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH ASSEMBLY
CALLING FOR A SPECIAL ELECTION TO BE HELD WITHIN THE CONFINES OF
THE KODIAK ISLAND BOROUGH ON TUESDAY, THE 25TH DAY OF JUNE, 1968,
AT WHICH TIME THERE BE SUBMITTED TO THE DULY QUALIFIED ELECTORS
OF THE KODIAK ISLAND BOROUGH THE FOLLOWING PROPOSITION:
"SHALL THE KODIAK ISLAND BOROUGH ASSEMBLY HAVE
THE POWER TO LEVY AND COLLECT A CONSUMER'S SALES
TAX NOT EXCEEDING TWO PER CENT (2%) OF THE SALES
PRICE ON ALL RETAIL SALES, ON ALL RENTS, AND ON
ALL SERVICES MADE WITHIN THE CONFINES OF THE
KODIAK ISLAND BOROUGH AND THE REVENUES DERIVED
THEREFROM TO BE USED FOR SCHOOLS AND SCHOOL PUR-
POSES."
WHEREAS, the Kodiak Island Borough, State of Alaska,
as a Second -Class Borough, is authorized under Section 07.15.010
Alaska Statutes to levy all taxes and special assessments, enforce
tax liens, and assess and collect penalties in the manner pro-
f vided for First -Class Cities, and
WHEREAS, Section 29 .10.357 of the Alaska Statutes providl
1 for the levying and collection of a Consumer's Sales Tax not
1 exceeding three per cent (3%) of the sales price on all retail
! sales, on all rents, and on all services made within a municipalit•_

and Section 2 9.10.360 Alaska Statutes provides that before such a
sales tax is levied, consent of the qualified voters of the munici-
pality shall first be obtained through a referendum vote at a
general or special election upon ballots which clearly present the
proposition whether or not a sales tax shall be authorized within
the municipality and whether the tax is to be levied for general
revenue for the municipality or for a special purpose, and, if for
a special purpose, it be specified on the ballot and

Borough Assembly that the imposition of such a sales tax is neces-

NOW, THEREFORE, BE IT RESOLVED by the Borough Assembly
of the Kodiak Island Borough, State of Alaska, that:
Section 1. That a special borough election be called
to be held on Tuesday, the 25th day of June, 1968, between the
hours of 8:00 a.m. and 8:00 p.m. of said date and that there be
submitted to the duly qualified electors of the Kodiak Island
Borough the following proposition:
"Shall the Kodiak Island Borough Assembly have
the power to levy and collect a Consumer's
Sales Tax not exceeding two per cent (2%) of
the sales price on all retail sales, on all rents,
and on all services made within the confines of the
Kodiak Island Borough and the revenues derived
therefrom to be used for schools and school pur-
poses."
Section 2. The manner of conducting and holding said
election and detail thereof shall be in accordance with the re-
quirements of the State Laws and Chapter Four of the Kodiak
Island Borough Code of Ordinances and Resolutions and any resolu-
tions of the Kodiak Island Borough as to special elections. The
ballop shall set forth the proposition as set forth in Section One,
followed by the words:
"Sales Tax, YES /7
Sales Tax, NO /7"
Together with special instructions as to the manner in
which the ballot shall be marked.
Section 3. Any person who is a qualified voter in Alaska
and is a resident of the Kodiak Island Borough is a qualified
voter with respect to the proposition.
Section 4. The polls of said election shall be open
during the time prescribed in Section One of this Resolution and
the polling places for said election shall be as follows:

tion shall be published in the Kodiak Mirror, a newspaper of
general circulation published in the Borough for three

on the Kodiak Island Borough bulletin board, and all such notices
shall be posted more than twenty (20) days prior to the date of
said election and the first publication of said Notice shall be
not less than twenty (20) days before the election.
Section 6. The Notice of Special Election shall be
signed by the Clerk of the Kodiak Island Borough and shall be
substantially in the following form:
NOTICE OF SPECIAL ELECTION
At a Special Election to be held in the Kodiak Island
Borough on Tuesday, the 25th day of June, 1968, the following
proposition will be submitted to the qualified voters of the
Kodiak Island Borough:
"Shall the Kodiak island Borough Assembly have
the power to levy and collect a Consumer's Sales

The boundaries of all precincts are as defined in the
Alaska Administrative Code and in the ordinances and resolutions
of the Kodiak Island Borough, and emergency regulations of the
Secretary of State.
Any person may vote who (1) is a citizen of the United
States; (2) has passed his 19th birthday; (3) has been a resident
of the State for at least one year just before the election; (4)
has been a resident of the Kodiak island Borough and the precinct

1 in which he seeks to vote for at least thirty (30) days prior to
the election and (5) can speak or read English unless prevented by
I physical disability.

may enact the tax as a levy upon buyers with imposition upon
I sellers of the obligation of collecting it at the time of sale or;

fied voter within the Borough who expects to be absent from his
election precinct on the day of election, or who will be unable to

vote in said Borough election precinct by reason of physical disa -I
bility on the day on which any general or special election is held,/
or if he believes that he will be unable to be present at the po1H

causing undue travel expense, hardship or hazard, may cast a ballo

in said Borough election upon complying with these provisions for
casting absentee ballots.
Application for ballots: Time requisite; Not more than
twenty (20) nor less than five (5) days for filing by mail, and
not more than twenty (20) nor less than one (1) day where filing
in person, prior to the Borough election, any voter, being properl
qualified, who expects to be absent from his election precinct,
or unable to vote therein on the day of election, may file either
in person, or by mail, his written application to the Borough
Clerk for an absentee voter's ballot. The application shall be
signed by the applicant, show his place of residence, and shall
make clear to the clerk of the Borough the applicant's right to a
ballot. The absentee voter must appear before any Notary Public
or any officer in the District, City, County, Borough, Territory
or other Federal District, or in any State, Territory or District
within the United States or in the District of Columbia, or before
two (2) attesting witnesses, both of whom shall be qualified
voter; of the Borough.

Section 8. The judges and clerks of said election to
be hereafter appointed by resolution of the Borough Assembly, shah
canvass the votes cast at said election on the proposition above
stated, and shall prepare and file their returns of said election
with the Borough Assembly, stating in words and figures, the numbe
of votes cast for and against the proposal voted on. If the votes
cast in favor of the proposition be not less than a majority of
the votes cast at such election, they shall certify that the
proposition carried and if otherwise, then that the proposition
failed.
