A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AN
ZONING COMMISSION OPPOSING PASSAGE OF HOUSE BILL 374 AND SENATE
BILL 283
WHEREAS, subdivision control is a proper devise for
bettering and fostering community development, and
WHEREAS, the orderly planned growth of undeveloped
areas within a municipality is best promoted through statutes
regulating land subdivision, and
WHEREAS, the development of subdivisions has a profo
effect on the growth of the community through the installation of
streets, utilities, parks and other open spaces, and through the
changes that said development occasions in the pattern of populati
density, and
WHEREAS, As 40.15.190 (2) adequately and properly
describes the meaning of subdivision, and
WHEREAS, Article 10, Sections 1 and 2 of the Consti-
tution of the State of Alaska provide for maximum local self goverri-
ment with local government powers to be vested in boroughs and
cities and Section 07.15.340 of Alaska Statutes provides that the
first and second class boroughs have the responsibility of plannin
platting and zoning on an area wide basis, and
WHEREAS, Section 07.20.070 (d) provides for weighted
voting for those who represent a first -class city which has a
majority of the borough's population and therefore adequate contra s
are provided to protect against the evils real or imagined.

NOW, THEREFORE, BE IT RESOLVED by the Kodiak Island
Borough Planning and Zoning Commission that this body go on record
as being strenuously opposed to the passage of House Bill No. 374
and Senate Bill No. 283 currently before the Fifth Legislature,
Second Session, in the Legislature of the State of Alaska.
BE IT FURTHER RESOLVED that true and correct copies
of this Resolution be forthwith furnished to the Assembly of the
Kodiak Island Borough, the Borough Chairman, the Borough Attorney,
the Chairman of the Local Government Committees of the Alaska Hous
and the Alaska Senate and to the Representative and Senator from
this district.
PASSED AND APPROVED this 13th day of March, 1968, by
the Kodiak Island Borough Planning and Zoning Commission.
