PE GROUP NO. FOUR (4) WHICH PLAT WAS RECORDED IN BOOK ONE (1) OFT
PLATS PAGE 77, SERIAL NUMBER 61,574 ON OCTOBER 31, 1961.

WHEREAS, THURSTON T. JACKSON and LOVEIS G.
petitioned the Kodiak Island B JACKSON have
Borough Assembly and the Kodiak
I Island Borough Planning and Zoning Commission for the vacation of
a portion of a plat known and described as the Subdivision of
Lot Twenty -four C (24 -C),
U.S. SURVEY No. 3099 and the Subdivision
4 of Lots One (1) through Nine (9) and Lot Sixteen (16) all of U.S.
''Survey No. 3233, Spruce Cape Small Tract Group No. Four (4) which
plat was recorded in Book One (1) of Plats, page 77, Serial Number j

I 61 -574, on October 31, 1961, the portion of said plat which the
Petitioners have asked to
be vacated being described as:
' i Blocks Two (2), Three (3) Four (4) and Five (5)
of said plat excepting from vacation however
the
hettwenty -five feet (25') line along the
Torte
(3) boundaries of Blocks Two (2) and
( ) of said plat which twenty -five feet
( was dedicated as a public street, and
it WHEREAS, as a basis for said Petition THURSTON T.

JACKSON and LOVEIS G. JACKSON have stated that at the time the

division was made they were not the owners of the property and
( further that at the time the plat was filed only 5,000 square feet
■l;was required for lot size but at this time the minimum lot size is ■
;7,200 square feet and therefore the public interest would best be 11 "served if this portion of the plat.above referred to were to be

WHEREAS, all persons interested were notified that a 11 I ....
.plic hearing would be held on said Petition on Wednesday, the

24th day of January, 1968, at 7:30 o'clock before the Kodiak
Island Borough Planning and Zoning Commission which public hearing
was duly noticed and held, a copy of the Affidavit of publication
having been filed herein and at which hearing the Planning and
Zoning Commission recommended that the above - described portion of
the plat be vacated, and the Kodiak Island Borough Assembly being
fully advised in the premises
NOW, THEREFORE, BE IT RESOLVED that that portion of the
Subdivision of Lot Twenty -four C (24 -C) U.S. Survey No. 3099 and
Subdivision of Lots One (1) through Nine (9) and Lot Sixteen (16)
all of U.S. Survey No. 3233, Spruce Cape Small Tract Group No.

Four (4) which plat was recorded in Book One of Plats, page 77,
Serial No. 61 -574, on October 31, 1961, described as:
Blocks Two (2), Three (3), Four (4) and Five
(5) of said plat excepting from vacation
however the twenty -five feet (25') line along
the Northerly boundaries of Blocks Two (2) and
Three (3) of said plat which twenty -five feet
(25') was dedicated as a public street
'be and the same is hereby vacated and that a copy
of this Resolution
be fired with the Kodiak District Recorder for notation to be
attached to said plat indicating the protion above described to have
been vacated in accordance with Sections 40.15.140 through
40.15.180, Alaska Statutes.
