1968-02 Approval ASHA Pilot Payment For Aleutian Homes.KODIAK ISLAND BOROUGH RESOLUTION NO. 68 -2 -R RESOLUTIc:. iP'RC /ING AJR3 ..NT '.., ITH DEPARTMENT CF HCU: _r.J 'U D UR'A:: D., i'^„;P "=:.T WHEREAS, the Secretary of housing and Urban Development has agreed to make a payment in lieu of taxes equal to real estate taxes that would otherwise be levied on the properties for the year 1967, now owned by the Government, in the Aleutian Homes, Inc., subdivision of the east addition, Kodia ;c, Alaska; and 4hSREAS, said Secretary has accordingly submitted an Agreement which has been duly read in open meeting, fully con- sidered in accordance with all pertinent rules of procedure and legal requirements, and made a part of the Kodiak Island Borough Assembly's records; and :'!E :a:vss, it is deemed advisable that said - ..;reement be accepted; NOd, :ii :RSFCHE, be it resolved by the Kodiak Island Borough Assembly that the said Agreement, a true and correct copy of welch is hereto attached, be and the same hereby is accepted without reservation or qualification, and the proper officials of the Assembly are authorised tc execute documents evtlenc'_ng such acceptance and take such further action as is necessary to provide the Project. '.'saver, Administrator, Hous'_n.• and home Finance +gency, datel August 31, 17 65; and 'Ci ?SEAS, all state and local taxes assessed against the property described in the above_identizied conveyance, including a payment in lieu of taxes for tha tax year of 196; in the amount of $58,214.90, have been paid and WHIMS, the Housing and Home `finance Administrator is still the owner of record of all the property described it the above.. identified conveyance except the following described properties, Block 32, Lo 1 2, 3, Slack 31, , 2, 4 5, 6, 7, 3 , 9, 10 and 11; 2, , , 7 and 81 Block 36, Lots 1, 2, 3, 4, 5 and 6 Block 37, Lote 13, 14, 15 and 16; All in the Aleutian Homes, Inc., Subdivision of the Fast Addition, Kodiak Townsite, Kodiak, Alaska, but it is anticipated, and the Secretary is in the process of conveying Lots 1, 2, 3, and L in Block 8 of the same subdivision to the city of Kodiak; and WHe36A5, there has been an adjustment in the valuation of the above - described properties as a result of a partial, reaesesement of the real property in the city of Kodak by the Tax Assessor for Kodiak Island 3 orough and it is computed the Municipality has been deprived of 1 1 1 q i state and local taxes for the tax year of 1967 on the properties remaining in the name of the Housing and Home Finance Administrator in the amount of 367,296.94 that would normally accrue to it if the properties had not been exempt from taxation; and •riER7AS, there is legal authority vested in the Secretary as successor to the Housing and Home Finance Administrator to enter into agreements with state and local. ;axing authorities (Public Law 139, 82nd Congress; 65 SPAS. 29 3,311; (12 USCA 17013_ 170184) and such authority has been redelegated to the Director for Northwest Operation by action of the Administrator, Robert C. Weaver, and the Regional Administrator, Robert B. Pitts, by appropriate delegation and redelegation of authority, both dated October 1, 1965 (not published in the Federal Register); and HFRSAS,. the Secretary has sustained damages in the amount of $3,290 as a result of the actions of legislative bodies of the city of Kodiak and the Kodiak Island Borough in his effort to construct a warehouse for storage and maintenance of supplies in connection with the operation of the above described properties, and it appears equitable to deduct said amount of damages from any payment the Secretary makes in lieu of taxes, together with the assessment against the four lots mentioned in paragraph 5 herein that would normally accrue; NOW, THEREFORE, in consideration of the mutual covenants hereinafter set forth, the parties hereto do agree as follows; 1. Secretary agrees to pay the aum of sixty -three thousand eight hundred and thirty-six dollars and seventy -seven cents (•$63,836.77)to the Municipality as payment i m._.. _e payment -- -.. -�.. �. taxes, which sum represents the amount of taxes for the tax year of 1967 th would have been levied against the property referred to herein except for acquisition thereof by the United States of America, less the amount of the damages referred to herein above. 2. Municipality agrees to accept p s id sum in Tint settlement of all claims for payment in lieu of taxes against said property through December 31, 1967. 3. Municipality agrees to distribute the payment in lieu of taxes among the taxing bodies in the proportion mica: the real property taxes would have been paid to each taxing. body for the year of 1967.
