A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK
ISLAND BOROUGH PURSUANT TO Section 40.15.170, ALASKA STATUTES.
WHEREAS, CLARENCE JEFFERS, CECIL SHOLL, PHYLLIS SHOLL,
THOMAS FROST, SR., and SUSAN FROST, have petitioned the KODIAK
ISLAND BOROUGH PLANNING & ZONING COMMISSION for the vacation of
a portion of Hillcrest Avenue and Spruce Lane, as more particul
arly set forth in that certain plat dated October 29, 1965, by
G.S. BEST, Registered Land Surveyor, entitled "Vacation, Hfllcre!t
Avenue and Spruce Lane and Replatted to Lot Seven A (7 -A), B'Iock
Seventeen (17), and Lot Thirteen B (13 -B), Block Sixteen (16),
Kodiak Townsite, U. S. Survey No. 2537 B7 and,
WHEREAS, pursuant to said Petition, a public hearing was
held on Tuesday, the 23rd day of November, 1965, at which time
all persons interested could be heard and after which hearing the
PLANNING & ZONING COMMISSION has recommended the vacation of a
porting of Hillcrest Avenue and Spruce Lane.
eneRflu NOW, THEREFORE, BE IT RESOLVED by the KODIAK ISLAND
BOROUGH ASSEMBLY, that that portion of Hillcrest Avenue and Spruce
Lane, as set forth in the plat dated October 29, 1965, by G.S.
BEST Registered Land Surveyor, entitled "Vacation, Hillcrest Av-
enue and Spruce Lane, and replatted to Lot Seven A (7 -A), Block
Seventeen (17) and Lot Thirteen B (13 -B), Block Sixteen (16),
Kodiak Townsite U. S. Survey No. 2537 B ", be and the same is her -
by approved and that portion of Hillcrest Avenue and Spruce Lane
shown thereon as part of Lot Thirteen B (13 - B), Block Sixteen (1!)
and Lot Seven A (7 -A), Block Seventeen (17), be and the same is

WHEREAS, Section 7 of Ordinance Number 64 -4 of the
KODIAK ISLAND BOROUGH provides that a final plat shall be approv-
ed by the BOROUGH ASSEMBLY by resolution, which resolution shall
for the acceptance of all streets, alleys, easements or
other open spaces dedicated to public purposes, and
WHEREAS, CECIL SHOLL, PHYLLIS SHOLL, CLARENCE JEFFERS
have presented for approval their final plat of the vacation of
portion of Hillcrest Avenue and Spruce Lane, the same being re-
platted as a portion of Lot Thirteen B (13 -8), Block Sixteen (16

and Lot Seven A (7 -A), Block Seventeen (17), Kodiak Townsite, an
dedicating a walkway designated as Lot Thirteen A (13 -A), Block
Sixteen (16);
NOW, THEREFORE, BE IT RESOLVED, that the KODIAK ISLAND
BOROUGH ASSEMBLY grant its approval to the final plat presented
by CECIL SHOLL, PHYLLIS SHOLL, and CLARENCE JEFFERS, of the vacal
tion of a portion of Hillcrest Avenue and Spruce Lane and replat{
ting the same to Lot Seven A (7 -A), Block Seventeen (17) and Lot
Thi'nOen A and Thirteen B (13 -A & 13 -B), Block Sixteen (16), Kodia
Townsite, and that the KODIAK ISLAND BOROUGH ASSEMBLY accept all
streets, alleys, easements, and other open spaces dedicated to
public purposes as set forth in said plat.
