Special Assembly Meeting
April 21, 1992
A special meeting of the Kodiak Island Borough
Assembly was held April 21, 1992, in the borough
conference room in the. Kodiak Island Borough
Building, 710 Mill Bay Road. The meeting was called
to order at 7:30 p.m.
There were present:
Jack McFarland, Presiding
Gordon Gould
Suzanne Hancock
Mike Milligan (arrived at 7:36 p.m.)
Mary Monroe
Gary Stevens (arrived at 7:34 p.m.)
absent:
Betty Fitzjearl
comprising a quorum of the Assembly; and
Jerome Selby, Borough Mayor
Donna F. Smith, Borough Clerk
Judi Nielsen, Deputy Clerk

A. RESOLUTION RESOLUTION
1. Resolution No. 92 -17 Concerning Building RESOLUTION
Security. NO. 92 -17
If adopted, Resolution No. 92 -17 barred Mr. Gilbert
Wilson from entering the Kodiak Island Borough
building premises for a period of ninety days because
his previous action interfered with the entitlement
of the assembly and the public to assemble peaceably
for the conduct of public business.

STEVENS, moved to adopt
seconded by MONROE Resolution No. 92-17.
The Assembly discussed with Joel Bolger, Borough
attorney, the resolution prepared by Mr. Bolger and
possible alternatives. Mr. Bolger advised the
Assembly that the adoption of the resolution was
probably most effective. He continued by saying that
Kodiak Island Borough Code 18.35.020 defined
trespassing.
When concern was expressed naming the individual in
the resolution, Mr. Bolger pointed out that Gilbert
Wilson had to receive personal notice in order to
enforce the trespass ordinance.
Presiding Officer McFarland added that the public's
safety could not be risked in a public forum and
emphasized that this resolution lent immediate
protection.
