III ITEMS OF BUSINESS 1. Appeal Block 1, Russell Estates (Vacation o 10, and Repeat to Lot 10A, Block 1, Russell Estates). Mr. Robert Mahoney, attorney, presented the case for Mr. Capas to appeal the P 6 Z Commission denial of the request for vacation and replat. It was pointed cut that Mr. Capas had met all minimum requirements as requested by the Planning Department. This property is in two different zoning districts, R -3 and unclassi- fied. Although the boundary line could be vacated between the two parcels, the zoning line would remain. If at some future time the unsubdivided property were rezoned, the use of that land would change to conform to the zoning. Two members of the P 6 2 Commission stated their reasons for voting to deny this request. A five-minute recess was called at 7:05 P.M.; meeting reconvened. It was stated that the building permit was issued and was in order.
