Motion made by Or. Emmick for acceptance of the minutes as a group. Seconded by or. Anderson. Lotion passed with a unanimous voice vote. V. C ialliICATIOiS AHD APPEARANCE REQUESTS A. Letter was read in full by ;it's. Wallin received from Mrs. Richard Ayser requesting the purchase of Lot 24, Mock 14 of Townsite, USS 2537 -9. The appraised value of this property is $2,070. Dr. Emmick moved to take the application for pur.:h=_ce of this lot under consideration with the stipulation that it return to the Assembly at the next regular meeting with other infor- mation as tc other prooert owners, and if it has to go for Qublic bid. Seconded by hr. Anderson. .btion passed with a unanimous voice vote. B. Letter was read by r:rs. Wallin from the property owners of Island Vista Subdivision dated September 4, 1976 stating their desire to appeal the de- cision of the Borough .Assembly made on September 2, 1976 concerning the permfegiven to Kodiak Electric Association for use of the road right -of -way without restriction. The appeal presented contained the signatures of 13 property owners and 2 residents. The borough Planner stated KEA does have guidelines to follow. There was a meeting with the property owners and KEA after the correspondence which was presented was written resolving the problem so far as the nechanics of the permits was concerned. Nr. Davidson, representing the property owners, stated they felt they were hurried into the matter of utility placement which caused the filing of the appeal. .Also, it was hoped that through the presentation of the appeal would urge the Assembly to take necessary steps in the future for well planned utilities in other subdivisions. No action was required. C. .Mr. Harold Brighten, District Sanitarian, requested an appearance re- garding the Tony Perez property on Spruce Cape Road, Lit 19, USS 3101. Letters were presented dated September 10. July 29. my 2, A 26 and July 3, 1974. The Assembly was notified that action was being planned in order to speed Mr. Perez up in resolving the unsightly situation which exists, causing harborage for rats, so that there is not a sanitation hazard in.the location of the Perez property. It was suggested by Mr. Brighten that this matter be given t' the Borough Attorney for action. It has taken Mr. Pere: two years to comply with the request to rectify the junkyard situa- tion which is also a zoning violation as well as a rat harbor and eyesore to the nnnnnn4 , 4.,u ai.,„„e ne a Mull/finer nff4rial. Seconded by Mr. Peotter. Motion passed with a unanimous roll call vote. VI PUBLIC HEARINGS There were none. VII OLD BUSINESS A. Letter was read in full by Mr. Peotter from the Borough Attorney in re- gard to Mr. Gene Brasie Lease, Attorney file #101 -K28 dated October 5, 1976. Mr. Anderson stated that in light of the information received from Mr. Sharon it would seem that this Assembly has no recourse but to direct the AQpraiser to reappraise or reevaluate said lands and upon receipt of the appraisal the Assembly would know what course of action to take which Tie made in a form of a motion. Seconded by Mrs. Kavanaugh. Carried with a unanimous voice vote. B. Letter read in full by Or. Enmick from Borough Attorney dated October 5, 1976 re: Grading Permits No. 442 -445, Permittee: L. J. Grothe - Attorney File #101 -K37. Dr. Enmick moved to accept the letter for discussion. Sec- onded by Mr. Peotter. It was felt that the Assembly was unable to take appropriate action as the attorney did not have a complete file. Dr. Enmick withdrew his motion with permission of the second. In light of the with- drawal, Mr. Anderson moved to refer the Grothe grading permit #441 -445 back to the Borough Attorney for his complete analysis after receiving the entire file on hand. Seconded by Dr. Enmick. Motion carried by unanimous voice vote. VIII NEW BUSINESS A. Resolution No. 76 -49 -R approving final plat of Lot 1, Block 7, Bells Flats Alaska Subdivision, Larry L. & Darleen Shorb. for. Anderson moved for approval of Resolution No. 76.49 -R. Seconded by Mrs. Kavanaugh. Motion passed with a unanimous voice vote. 8. Resolution No. 76 -50 -R, Dean Taylor - was withdrawn. C. Resolution No. 76 -51 -R approving vacation of utility easement of Lots 4 S 9, Block 14, New Kodiak Subdivision and Replat of Lots 4A & 5A, Block 9, New Kodiak Subdivision, Carpenters Local 2161. Cover letter from Mr. Denslow was read by Mr. Anderson stating that the City of Kodiak, by Resolution No. 17 -76 dated September 9, 1976 abandoned any interest in said easement for sewer and water purposes. Based upon terms with KEA and Glacier State Telephone that there will be adequate and alternate easements available on the property to be negotiated between the utilities and the property owner, and that the cost of the relocation be borne by the property owner and not the utility, the Planning and Zoning Commission recommended this vacation be approved. Mr. Peotter moved for the adoption of Resolution No. 76 -51 -R with the stipulation pointed out in the letter by Mr. Denslow. Seconded by Mrs. Kavanaugh. Motion pasted with a unanimous voice vote. D. Resolution No. 76 -52 -R approving final plat of Vacation of Lots 4, 5, 6, Block 9, New Kodiak Subdivision and Replat of Lots 4A & 5A, Block 9, New Kodiak Subdivision; L. P. Martin and F. P. Moore. Mrs. Kavanaugh moved for approval of Resolution 76 -52 -R. Seconded by Dr. Emmich. Motion passed by a unanimous voice vote. E. Resolution No. 76 -53 -R providing names of Alaskan origin for presently unnamed streets in the Island Lake area. Mrs. Kavanaugh read the cover letter to Carolyn Briseo and property owners naming the streets in the Island Lake area as follows: the street which,is parallel and nearest to Island Lake be named Artic Tern; nearest street parallel to Artic Tern be named Ptarmigan .Pass and the street perpendicular to Island Lake be named Kittiwake. Dr. Emmick moved for adoption of Resolution 76 -53 -R. Seconded by Mr. Peotter. Motion passed by a unanimous voice vote. First reading of Ordinance No. 76 -18 -0 making supplemental transfer of certain appropriations within the 1976/77 budget setting forth unanticipated revenues, read by title only by Frank Peterson. Mrs. Kavanaugh moved for adoption of Resolution 76 -18 -0. Dr. Emmick seconded. It was noted that the request for a file clerk was not included in the ordinance. Since there is a need in the Borough offices for this, it was suggested that the NYC workers be checked into for after - school job training. Also, item 1241.06 should be changed from HUD to OCS as the HUD funding is going to be utilized In another part of the State, it was noted. Question called. Motion carried b unanimous voice vote. The Assembly requested the Mayor to check into NYC program. G. Or. Emnick moved for the adoption of the tax adjustment as submitted by the Assessor for Samuel Graber. Seconded by Mrs. Kavanaugh. Motion passed with a unanimous voice vote. H. Mrs. Kavanaugh moved for approval for Rudolph Reimnitz tax adjustment request. Seconded by Mr. Peotter. Passed by unanimous voice vote. I. The Expenditure Report for September was reviewed. No action was necessary. IX MAYOR'S REPORT A. In the absence of the Mayor, Mr. Denslow a anented on the letter dated July 26, 1976 from Department of Comnunity and Regional Affairs in regard to the protest of the proposed annexation of the Alaska Peninsula by the Bristol Bay Borough. Mr. Anderson stated that Kodiak Island Borough was looking toward annexation of that very same area. Follow up was needed on this. The short response was not adequate, nor specific. The Assembly re- quested the Planner to follow through on this matter. 8. Letter dated October 1, 1976 to Mr. A. E. Gerken, City Manager was pre- sented re: City of Kodiak request to acquaire Lot 10, Block 6, Leite Sub- division. The appraised value made by Borough Assessor is $5,180. The parcel to the City of Kodiak is to be transferred for an initial payment of $1.00 plus an accrued value for public safety of $5,179 duly certified to the Borough on or about November 2, 1997. X ASSEMBLY COMMENTS A. Mr. Anderson stated that a discrepancy has been discovered that indivi- duals who live on the Coast Guard Base do have the right to vote. He feels that the people who live upon the base do have the right to vote in the Borough election because if they don't, it is an explicate example of taxa- tion without representation. It is his opinion that the Govenor sent a docmknt to someone on the Coast Guard Base stating that those on the Ise have the right to vote. The letter mentioned does not specifically say "Borough Elections ", it was noted. Mrs. Kavanaugh moved to direct the ad- ministration to send a letter to Patty Polley for clarification specifically . asking about cityy, borough h and state elections. Seconded by Mr. Peotter. Motion passed with a unanimous voice vote. B. Mrs. Kavanaugh asked when a Building Official would be hired? Mr. Dens - low responded with the statement that there were 18 names of people which were being interviewed at the present time for this position. C. Mr. Peotter expressed concern about the expenditure financial statement. It was suggested that a monthly worksession be held on Wednesdays at noon before the monthly the regular monthly meetings to discuss the financial reports and for review. D. OCTOBER 7, 1976 PAGE 4 XI AUDIENCE COMMENTS A. Mr. Tony Perez commented that the Sanitarian notified him of the pre- sentation of his case to the Assembly. In regard to the charges made by the Sanitarian, Mr. Perez asked what constituted a junkyard? He stated he had no rats or garbage. The Assembly informed Mr. Perez that the decision made was to forward his file to the Borough attorney for clarification. When asked if any of his neighbors complained to him of the situation, he replied: "One ". It was suggested he get statements from the other neigh- bors. He also informed members of the Assembly that he was the Civil Defense Coordinator for outside the Borough.
