I CALL TO ORDER
The Special Meeting of the Kodiak Island Borough Assembly was calls
to order at 7:30 p.m. by Acting Presiding Officer Wilton White,at
Borough Meeting Room, Kodiak, Alaska.

Thirteen ballots were not accepted due to (1) not being on the
state list as registered voter; (2) having been purged from the sta.
list or (3) not complying with the requirement for timely change of
precinct and voting district. Total ballots:

Ballots were counted and Resolution No. 75 -52 -R was read in full
noting that Rollyn Ball received 368 votes for mayor; Robert Craig,
368 for mayor; James L. Fisk, Jr., 96; Charles Davidson 181, and
Charles Powell, 332, and calling for a run -off election between
Rollyn Ball and Robert Craig.
The resolution further noted that the following votes were cast for:
Leslie Anderson 660; M. Clark Fultz 289, Hal Lincoln 704, Arne 0. Re
454; Omar Stratman 491 and Betty Wallin 789, declaring Betty Wallin
Hal Lincoln and Leslie Anderson as being elected. Don Brunner 447;
Murl Estes 563; James Peotter 586; Frank Peterson 567 and Pat Poland
165, declaring James Peotter and Frank Peterson has being bleated;
Michael Emmick, 545; Sandra Kavanaugh 595; Dan Ogg 167; Nicholas
Pestrikoff 521; Timothy Ward 469, declaring Sandra Kavanaugh and
Michael Ermick as elected officials; Louise Collins 604; James L.
Fisk, Jr., 187; Hazel E. Hogan 393; Joan Johnson 502; and Stan
Sargent 290; declaring Stan Sargent and Louise Collins as elected;
Richard Swank received 290 for the same position. Phil Anderson,
171, Stan raltzo 578 and J. D. Kulp received 552 - declaring
Stan Baitzo as elected school board member. Proposition No. 1
failed by count of 530 YES votes to 833 No votes; Proposition
No. 2 failed with 514 YES to 833 NO votes.

Mr. White asked for comments from the audience. Attorney George vo,
stated that he was speaking on behalf of his client Mr. James L. Fi:
and that he had an affadavit protesting the election on two counts.
One, that the ballots had been altered after they had been approved
as official. Mr. Vogt ited a case in point, where a candidate had
died prior to the election, however his name remamcd on the ballot
Mr. Vogt went on to state that by removing the names from the
ballot everyone did not have the same opportunity to vote on those
individuals as did others - pointing out that the ballots in the
village areas still had the names of the candidates on them.
Mr. Fisk was protesting the election on another coUht that being
that the pr-position for the exemption of Borough officials from
the requirements of the State Disclosure law was unclear and that
the people were confused as to the outcome of a particular vote.
Mr. Vogt was requesting that the the Assembly not ratify these
two portions of the ballot, that the position of two -year assembly
man, one -year school board and the proposition on Disclosure be
placed on the ballot for the run -off election. Mr. Vogt went on
to say that this presentation was an effort on their part to seek
administrative action and that the next step would be to file in
court.
Mr. White thanked Mr. Vogt for his comments and asked if the
assembly members wished to make comment at this time.
Mr. Vogt further stated that he felt the disclosure requirements
were an envasion of privacy and that there were certain profession
who would not be able to take public office because of this 1:v:.
Mr. Further stated that the voters did not have a copy of the law
and that the ballot should have included a statement to the effect
the law would have and exactly what the Alaska Statutes said in thi
regard.
Mr. Estes stated that the resolution should be passed and that
Mr. Vogt had some ten days in which to file should he so desire.
The question was called and motion passed by unanimous roll call
vote.
B. Swearing in of Newly Election Officials.- Six of the members we
present and were sworn in.
C. Call for Special Election for Runoff Between Rollyn Ball and
Robert Craig for Mayor's position. Date for the Runoff Election h;
been set tor novcmner 24, 1975.
ADJOURNMENT
The meeting was adjourned at 10:30 p.m.
