03/25/1974KOQI1 WIC t )RO& S EG4ALtS$EM1 MEETING MAR 25, 1974 CALL TOORSER The meeting was called to order by Deputy Presiding Officer, Mr. tennis Nelson, at 7 31 p.m. in the Courtroom of the State Office Building. 11 ROLL CALL PRESENT ABSENT Mr. C. Ross Wood, Borough Mayor Mr. Dennis Nelson Mrs. Betty Wallin Mr. Howard Anderson Thera were approximately twenty people In the audience. Mr. Fred Brechan (on vacation) Mr. Charles Powell (on vacation) III PUBLIC HEARINGS A. Second Reading and Public Hearing on Ordinance 74-6 -0 - Relating to the Composition, Organization, and Procedures of the Borough Assembly.- Mrs. Wallin moved that we accept Ordinance 74 -6 -0. Seconded by Mr. Anderson. Mr. Nelson closed the regular meeting and opened the public hearing. Mr. Nelson feels that under Section 3 there should be a limit on special meetings and that special meeting held more than once each month should not be compensated for. Mrs. Hans asked If the Borough could afford this? Mr. Nelson felt that the Borough could budget for this, but then budgeting for special meetings and work sessions would be difficult. Mr. McBride stated that compensation was given to other Borough's because of the distance thex had to travel, he feels that this is not so for Kodiak.. Mr, Nelson closed the public hearing and reconvened the regular meeting. Mr. Anderson feitthat there should be a flat fee if attend the regular scheduled meeting. It was suggested that Nes)bers $50.00 per month be the flat fee basis provided that the member atlutded the regular meetings. Mr. Nelson stated that another public hearing will be held on this ordinance at the next scheduled meeting. B. Second Reading and Public Hearings on Ordinance74 -7 - /l6IetIno to the Interpretations and Application of Provisions of the Kodiak island Borough Code of Ordinances - Mrs. Wallin moved to accept Ordinance 74 -7 -0. Mrs. Holt stated that these are merely housekeeping ordinances for the codification of our code. Mr. Anderson seconded the motion. Mr. Nelson closed the regular meeting and opened the public hearings. Mr. Large asked why Resolutions were law, he thought only ordinances were law. Mr. Zahn stated that the State Legislature passed many resolutions everyday, that ware Rotnecassarlly law. Mr. Nilson closed the public haring and reconvened the regular meeting. Mrs. Wallin amended her motion to state that we withhold the passing of this ordinance until we check with the Boroughi,Attorney to see if both Resolutions and Ordinances should be in this section. Mr. Anderson concurred. Motion passed by unanimous roll call vote. C. Second Reading and Public Hearing on Ordinance 74 -6-0 - Relating to Penalties Prescribed for Violations of Ordinances - Mr. Anderson moved to accept Ordinance 74 -8 -0. Seconded by Mrs. Wallin. 0 KODIAK ISLAND BOROUiH SPECIAL ASS MEETING MARCH 25, 1974 PAGE TWO (Public Hearings continued) Mr. Nelson closed the regular meeting and opened the public hearing. Mr. Large asked if this would affect violations on Borrow sites. He further stated that he has no objection if this is a respectable ordinance. Mr. Nelson stated that the Borough Assembly has in the past taken each case individually. Mr. Nelson closed the public hearing and reconvened the regular meeting. Motion passed by unanimous roll call vote. D. Second Reading and Public Hearing on Ordinance 74 -9 -0 - Relating to-General Personnel Regulations - Mr. Anderson moved for acceptance of Ordinance 74 -9 -0. Seconded by Mrs. Wallin. Mr. Nelson closed the regular meeting and opened the public hearing. There being no comments the public hearing was closed and the regular meeting reconvened. Mr. Nelson lad a question on the senority for leave. Mrs. Holt stated that it would be based on how long the employees have worked for the Borough, but the leave would not be retro - active. Motion passed by unanimous roll call vote. IV NEW BUSINESS A. First Reading of Ordinance 74 -10 -0 - Authorizing the Expenditure of 000700 for the Bond Escrow and Additional Monies for the Hospital - Mr. Nelson read the memo from the Comprehensive Health Hoard stating that there was an immediate need to meet hospital payroll and general operating expenses that are due April 1st, 1974 in the amount of $35,000.00. Thar reasons for said request are based on (a) extremely low occupancy for a six -month period; (b) late third party payments; (c) continuous fixed sxpenset The committee further recommended that in view of the consistent need for assistance to operate and maintain the Kodiak Island Borough Hospital that the Assembly recognize that with continued low occupancy rate there will be future requests for additional funds, they also recommended a renegotiation of the contract between the Borough and the Grey Nuns of'the Sacred Heart. Mrs. Wallin moved to accept Ordinance 74 -10 -0 in the flrst reading. Seconded by Mr. Anderson. Mr. Mulcahy stated that it will take the $35,000.00 to meet the April 1st payroll and the continued operating expenses. Mr. Anderson asked If the $35,000.00 would contain the payroll and operating expenses just for a month Mr. Mulcahy went on to explain the chart the board had presented to the Assembly on the past and present expenses of the hospital and also the occupancy rate during the past year. Mr. Mulcahy stated that he believes that the Assembly will have to subsidize the hospital to continue its operation. The occupancy rate has been below average. Mr. Nelson asked the difference between the accounts receivable and accounts revenue. Mr. Mulcahy stated that one was billed and one was accrued. Mr. Anderson stated that when the occupancy rate Is low, the expenses should be low also. Sister Claire noted-that several people have to be on call all the time and these are paid people. Mr. Mulcahy stated that thigsituatlon is happening all over the nation with hospitals our slur. rater Claire stated that they are keeping the minimal amount of employees. Mrs. Springhill stated th at they should consider the immediate problem, but also consider a worksession with the board and try to solve the long range problem. Mrs. Holt stated that she only had $30.000.00 in the ordinance and that the additional monies should come out of the land sales as a loan if the assembly wished. The amount to come out of land sales would be $9.036.55, to be paid back as hospital expenses. This would be Account 500. Mr. Anderson so moved as declaring $9,036.55 as a loan from the land Sales. Seconded by Mr. Anderson. Motion passed by unanimous roll call vote. C. Fi i•st Reading of Ordinance 74 -12 -0 - Relatinq to Collection of Personnel Property Taxes and Enforcement of Tax Liens - Mrs. Wallin moved to accept Ordinance 74 -12 -0 in the first reading. Seconded by Mr. Anderson. Motion passed by unanimous roll call vote. D. First Reading of Ordinance 74 -13 -0 -An Ordinance Clarifying Qualifications of Agents to Bid for Lease or Purchase of Real Property - Mr. Anderson moved for approval of Ordinance 74 -13 -0 in the first reading. Seconded by Mrs. Wallin. Motion passed by unanimous roll cafe. E. First Reading of Ordinance 74 -14 -0 - Regulating Excavation of Materials - Mrs. Holt stated that these are draft ordinances prepared by the At torney last week. She further stated that the Planning and Zoning Commission recommended approval of two of these and the other brought back to them. with recommendations from the assembly. Mrs. Wallin moved to accept Ordinance 74 -14 -0 in the first reading. Seconded by Mr. Anderson. Mrs. Holt stated that the P62 Commission recommends deletion of Section 1, Paragraph D. They feel it is already set out in the code. Mrs. Wallin amended her motion to approve the ordinance with the recommendations from the Planning and Zoning Commission to delete Section I, Paragraph D. Mr. Anderson wanted to hear what the public had to say. Mr. Zahn felt that in this section it should read property owners within 300 feet. in other words. he felt it should be clarified. Mr. Nelson stated that the amendment to the motion died for lack of second. Mr. Zahn asked if the Borough considered adoption as an emergency ordinance. '.+r '.eison stated that the public hearing will be next week at the regular meeting The ordinance will become effective immediately. Mr. Grothe brought up the question as to whether or not that section was an expost -facto Mr. Wood stated that he does not think it is expost- facto. Question being called for motion passed by unanimous roll call vote. F. First Reading of Ordinance 74 -15 -0 - Regulating Severence of Conifers - Planning and Zoning did ask for the Borough Assembly's comments on this ordinance. Mr. •Anderson felt it should be referred back to PSZ Mr. Legget stated that if he owned property, he should be able to cut ail the trees off of it he wants to. Mr. Anderson stated that this should be clarified more. Mr. Schneider pointed out that this is merely for logging Mr. Anderson stated that perhaps we should put an acreage size limit in this ordinance. Mr. Nelson ruled that this be referred back to PIZ. wtn the recommendations of the assembly. G. First Reading of Ordinance 74 -16 -0 - Regulating Disposition of Tree Stumps b Associated Organic Materials - P6Z recommends a "do pass" on this ordinance. Mr.•Anderson would object to the phrase "material originated on the lots ". He feels that stumps are eyesores. Mr. Anderson moved to approve the ordinance with the deletion of "unless the material orqi hated on the lot, or ". Seconded by Mrs. Wallin. Mr. Grothe asked if this would stop present stump sites. The assembly stated that the people would probably have to get a use permit. Question being called for, motion passed by unanimous roll call vote.
