01/17/19741 0 1, 2 0 1 5 2 KODIAK ISLAND BOROUGH ASSEMBLY SPECIAL MEETING - JANUARY 17, 1974 CALL TO ORDER Presiding Officer Charles Powell stated that if there were no objections from the members of the Assembly he would declare this a Special Meeting, held after the work session with the Koniag Corporation Officers; no objections being voiced the meeting was opened at 9:30 p.m. in the Koniag Conference Room, Kodiak, Alaska. II ROLL CALL III PURPOSE OF MEETING A. Possible Protest of Native Villages, Bells Flats, Woody Island and Anton Larsen Bay. Mr. Powell noted that the purpose of the work session was to discuss with the Koniag Officers their thinking on the land selections and village certifications. Mr. Brechan and Mr. Anderson voiced the opinion that they did not feel the Borough should protest those villages. Mr. Brechan stated the concern was for those lots which the Borough sold at the last land sale. The State had given authorization for the sale by the issuance of a patent . It was felt that those people's rights should be protected, and that the Native Lands Claim should not dispossess this land from those people. Mr. Brechan moved that inasmuch as the State has issued Patent No. 1274 for the Bells Flats Subdivision and Russian Creek Subdivision, the Borough feels it is the responsibility of the State to protect the Borough's interest and subsequent third party interest in such land, seconded by Mr. Anderson. The question was called and the motion passed by the following roll call vote: Mr. Nelson - YES; Mr. Anderson - YES; Mr. Brechan - YES, Mrs. Wallin Abstained; Mr. Powell - YES. The assembly next discussed whether or not the Borough should protest the certification of the three villages; and it was felt that they should not. Mr. Anderson moved to have the Borough support the certiii_cation of the three villages, Anton Larsen Bay, Woody Island and Bells Flats, seconded by Mr. Brechan. Question called and motion passed by the following roll call vote: Mr. Nelson - YES; Mr. Anderson - YES; Mr. Brechan - YES; Mrs. Wallin - Abstained; Mr. Powell YES. At the work session held earlier during the evening the officers of Koniag had asked that the Borough Assembly not file a protest but that the Borough in fact support the certification of those six villages which the Area Director had declared ineligible. Mr. Nelson moved that a telegram or letter be sent to the Area Director:, BIA, asking him to reconsider his decision on declaring the six villages (Port Williams, Little Afognak, Litnik, Uganik, Ayakulik, Aiahtalik) 571 ^- ligible_ in view of the fact there were technical problems involving the census enrollment for each village and it is our understanding that these villages have the adequate enrollment as required by law, seconded by Mr. Brechan. The question was called and potion passed by the following roll call vote: Mr. Anderson - YES; Mr. Nelson - YES; Mrs. Wallin - Abstained; Mr. Brechan - YES; Mr. Powell - YES.
