II ROLL CALL III MINUTES OF PREVIOUS MEETING IV MINUTES OF OTHER MEETINGS VI PUBLIC HEAR a Present Absent Wilton T. Jackson (excused) Also present: about 15 persons in the audience, nuny delegates from the School District. A. Assembly - regular meeting - 12/4/69 - one correction noted. insert word "out" in Paragraph B title, under XII to read "taxation without Representation" Mr. Sutliff asked for unanimous consent in approval of the minutes as corrected, there no objections the minutes were so a c�ov . A. P&Z - regular meeting 12/10/69 - There were no comments B. School Board - regular meeting 12/8/69 - It was noted in the minutes that the Borough Chairman has been requested by the School Board for a clarification of • the action taken during the rezoning of the Bells Flats' area. The Chad/min has written to the School Board requesting a resume of the discussion held on this matter and specific questions concerning same in order that a reply can be given. The intent of the Borough Assembly in this matter was discussed and the point node that since it has not been determined exactly where the larger part of the population would be in the Bells Flats area that the reserve for a school site should be made once this has been determined. Further there is ;xdlii tional land availabi: that might be more suitable. V CORRESPQIDIIaZ AND APPEARANCE REQUESTS - NONE A. 2nd Reading and Public Hearing, Ordinance: Nov. 69 -35 -0 Ammdinng Chapter 6, adding Section 3.2 which allows repurchase of tax foreclosed lands by recorded owner. The Ordinance: was read in full by the Borough Chairman, at whist time a brief background was given on the reason for the ordinance. The Borough Code he r na.provisiai for disposal of tax foreclosed land other than by public auction this amendment would allow for re-purchase by the owner or norgatee prior to a public auction. D. Naughton moved for the adoption of Ordinance 69 -35 -0, seconded by Mr. Arndt. The regular meeting was recessed and the Public Hexing opened. Mr. Stetter voiced the opinion that this would be a very good orin:nce: to pass. Mr. Naughton asked if the land were not re.- purchased by the recorded owner would it then go up for public auction and this was answered in the affirmar Further noted by thee Chairman that as read in the Ordinance, the property would ix sold for the full amount applicable to the property under the Judgement of Rareclosure: would mean the court costs plus the taxes, penalty and int.sest. The Public Hearing was closed and te regular meting reconvened. The question was called and motion passed by unanincus roll call vote. B. 2nd bearing, Public Hearing, Ordinance 69.36 -0, Amending Chapter Three: by dufinirm "R_al property" for purpose of taxation. The Ordinance was rued in full by the. Borough Chaiaeun. Mir. Sutliff moved for the :dcption of Ordinanc 69 -36 -0, seconded by Mr. Naughton. The regular meeting was recessed and the Public huarine opened. The Borough Chairman gave short resume on the ordinance, noting that it was drawn up in order that persons wiShing to improve their property world not be penalized for this by have the assessed valuation increase. Mr. Sutliff moved for the adoption of Ordinance 69 -30 -0 s domed by Mr. Arndt. The mating was recessed and the Public Hearing Opened. Mr. Largo indicated that he would like to have. the 'r'ca known as Tract A classified 's 'Unclssifi:d" and felt that otters in the: area walla go along with this action. During the discussion of this point, :ir. Naughton mead from the. Setting Date for January Meetings: Since there are five Thursdays in the nu nth o anuary awn s suggested that the nusirngs be moved back one Thursday, thereby setting January 8th and 22nd as Borough Assembly mating data and January 15th and 29th for City Council. Request for Executive Session - The Borough Chairman requested a short executive' session at the close of the regular meting in order to discuss the applications_ for the position of Clerk/Treasurer.
