07/16/1964 RM9 fl 7 5 KODIAK ISLAND BOROUGH ASSEMBLY REGULAR MEETING JULY 16, 1964 The meeting was called to order in the Borough Office at 7:40 P.M. Assemblymen present: Lester, Alexander and Wright. Also present: Chairman Powell, Roy Madsen and Howard Fremlin. (1) Chairman Powell read a letter of resignation from Dr. A. Holmes Johnson, Chairman of the Planning and Zoning Commission. Chairman Powell suggested Marion Parker as a member of the Planning and Zoning Commission. No objections were voiced and Chairman Powell appointed Marion Parker to the Commission. (2) The minutes of the previous meeting were approved as read. (3) Vouchers 63 through 67 were reviewed and unanimously approved by the Assemblymen. (4) Chairman Powell read a letter from Ivor Schott, Superintendent of Schools regarding a $500,000. bond issue. A general discussion ensued as to just what authority the Borough has. Attorney Roy Madsen explained that the actual law as written is very sketchy as to application of Borough responsibilities. Chairman Powell suggested meeting with the school board in the near future. Assemblyman Lester suggested the School Board provide the Borough with their budget earlier than has been done in the •past in the City of Kodiak in order for the Borough to give it proper consideration. The discussion turned to the possibility of Tax Forgiveness of improvements and /or property lost in the tidal wave. Mr. Madsen explained that this could only be done by an act of the legislature. As the present law stands, there is no provision for any waiver of taxes. (5) The Mission Road WAter District was discussed. It was concurred that the Borough can assume the authority of Water Districts without an election if the Assembly is the Water District Board. (6) The second reading of Ordinance 64 -4 was read by title only. Assemblyman Alexander, seconded by Assemblyman Wright moved to adopt Ordinance 64 -4 in the second reading and it was unanimously carried by a voice vote. (7) Attorney Roy Madsen readby by title only Ordinance 64 -5, ZONING ORDINANCE OF THE KODIAK ISLAND BOROUGH. This Zoning Ordinance is enacted for the purpose of pro- moting health, safety, morals, comfort, and General Welfare. It is enacted to conserve and protect property values, to secure the most appropriate use of:land and to facilitate adequate but economical provisions for public improvements. This Ordinance is in accordance with a Comprehensive Plan and contributes to the desirable future development of the Borough, provides a method of administration, and prescribes penalties for the violation of provisions hereafter described. Assemblyman Wright, seconded by Assemblyman Alexander moved that Ordinance 64-5 be adopted in the first reading. A voice vote was taken and the motion carried. A copy of the Ordinance is to be sent to all of the Assemblymen. (8) The Proposed Zoning Map for the entire Borough was discussed. Chairman Powell asked if people could be prohibited from rebuilding to replace improvements lost in the tidal wave, which were commercial, even tho this might be in conflict with the new zoning regulations. It was generally felt that a person should be allowed to do this despite its conflict with the overall plan. (9) The Mission Lake area was discussed. Dr. Bob Johnsons plans to restore the lake and near road to his home were reviewed and restoration problems were also discussed. (10) It was suggested by Assemblyman Lester to hold an election on the water system as soon as possible. It was pointed out that an election cannot be held until the total costs are determined. At that time (approx. 30 days) this will be done. Meeting adjourned at 9:15 p.m.
