1977-43 Granting Preliminary Approval For A Restricted Residential Subdivision And Granting Certain Variances.A RESOLUTION GRANTING PRELIMINARY APPROVAL FOR A RESTRICTED RESIDENTI &L SUBDIVISION AND GRANTING CERTAIN VARIANCES. WHEREAS, The Planning and Zoning Commission has reviewed a restricted recreational subdivision plat submitted by Mr. Roy Ecklund, Registered Lan. Surveyor for Mr. Edward Opheim, and; WHEREAS, The Commission found that the proposed subdivision site is n•t accessable by land, and; WHEREAS, The proposed subdivision will have access limited exclusivel to those persons owning property within the subdivision, and; WHEREAS, There will be no dedicated streets within the subdivision and access to each lot will be via an access easement (40 feet) only, and; WHEREASE, The Kodiak Island Borough Code of Ordinance Title 16, Subdivision Regulation Section 16.28.010.requires any variance from the requirement of .aid title be approved by the Borough Assembly. NOW, THEREFORE BE RESOLVED by the Assembly for the Kodiak Island Borough that the varipces from Section 12.20 and 16.24 of the Code of Ordi ance are hereby granted subject to the following conditions: KODIAK ISLAND BOROUGH ASSEMBLY RESOLUTION # 77 -43 -R 1. That a restrictive covenant be attached to the final plat as follo s: "The a cuss and utility easements as shown on this plat shall be f the ex usive use of owners of lots within the boundary of this subdivision ". 2. ghat \access easements are not to be improved for vehicular use oth th as a jeep trail for transport of supplies. ATTEST 3. That a note be attached to the plat to read as follows: "The lots within this subdivision are accessible by water and air only. No surface road access is provided for and this plat has been accepted subject to that limitation ". PASSED AND APPROVED THIS 1st DAY OF SEPTEMBER, 1977.
