RESOLUTION NO. 77 -28 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH APPROVING THE
FINAL PLAT FOR RE- SUBDIVISION OF 11.3 ACRES OF LAND WITHIN
USS 1396 (Steen & Matlock).
WHEREAS, Title 16.12.050 of the Kodiak Island Borough
Code of Ordinances and Resolutions provides that a final plat
shall be approved by the Borough Assembly by Resolution, whic:z
Resolution shall provide for the acceptance of all streets,
alleys, and easements, and open spaces dedicated to public
purposes, and
WHEREAS, the final plat has been prepared by STEEN &
MATLOCK, and
WHEREAS, the Planning and Zoning Commission granted fin
approval of said final plat on June 29, 1977 including certain
variances and subject to the following conditions:
Variances
1. Minimum side yard -none
2. Minimum lot area -1008 square feet
3. Minimum rear yard -10 feet
4. Minimum lot width -16 feet
Conditions of Approval
1. That the Homer Owners Association Agreement contain
specific provisions covering:
a. common driveway maintenance within the project
b. exterior building maintenance
c. maintain outdoor lighting in common areas
d. maintain common area landscaping
e. liability insurance on common areas
2. Submission of a landscaping plan to be approved by
the Planning Department prior to start of construction
along with a narrative description of the landscaping
methods.
3. Submission of a site drainage plan to be reviewed
and approved by the city engineer.
4. Provide a signature block on the plat for acceptance
of dedications, roads, and utilities for operation and
maintenance by the City of Kodiak.
5. In the event of construction taking place in Phases,
the site plan shall reflect each phase. All improvement
for each phase are to be completed prior to the issuance
of Certificate of Occupancy within said phase.

6. All required landscaping for each phase is to b
completed prior to the issuance of Certificate of
Occupancy.
7. Receipt of a letter from the State of Alaska,
Department of Environmental Conservation and the Ci
of Kodiak approving the utility and road constructi
design plans.
8. No units are to be occupied prior to completion of
the off -site sewer connection designed to serve thi
project.
9. That at least two (2) parking spaces be provide
for each dwelling unit.
10. If the developer wishes to occupy any phase of he
development prior to completion of any of the site
amenity requirements, the Planning and Zoning Commi_sio
may accept a surety of escrow from the lending inst tu-
tion financing the project that sufficient funds exist
to cover the costs of said amenities.
11. That the developer will provide a site of at least
one acre within the site to be developed as an outd.or
recreation area. Completed plans for the recreatio al
area are to be reviewed and approved by the Plannin
Department prior to construction of Phase III of th
development. Construction of the recreational are
shall take place prior to the completion and occupa cy
of Phase III.
12. That the developer coordinate the inspection of all
public roads, sewer and water construction with the Cit
of Kodiak Department of Public Works, and that all _uch
construction be approved prior to acceptance by the Cit
for operation and maintenance.
13. That the total number of townhouse lots within he
subdivision shall not exceed one hundred thirty -two
(132) .
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Isla d
Borough Assembly grant final approval to the final plat prese ted
by STEEN & MATLOCK as shown on the final plat prepared by Cosy
Steen, Registered Land Surveyor dated May 23, 1977 and that ail
streets, alleys, easements, and other open spaces dedicated f
public purposes shown on the same plat are hereby accepted.
