A RESOLUTION OF THE ASSEMBLY OF THE
KODIAK ISLAND BOROUGH ENDORSING AND
RATIFYING THE APPOINTMENT OF THE CURRENT
BOROUGH ADMINISTRATOR NOTWITHSTANDING
AS 29.23.130
WHEREAS, the Kodiak Island Borough electorate adopted
the hired manager plan at the regular municipal election held o
October 5, 1976;
WHEREAS, the borough assembly hired a borough manager
in December of 1976 to be the chief administrator of the Kodiak
Island Borough consistent with the expressed desire of the Boro gh
electorate;
WHEREAS, the employment of Stuart Denslow as borough
manager added a dimension of professionalism and competence to he
administration of Borough government which was the manifested
desire of the Borough electorate;
WHEREAS, the apparent meaning of AS 29.23.130 (d) man
dates that the manager plan as adopted by the Borough electorat-
be effective no sooner than following the certification of the
results of the October 4, 1977 regular election; and
WHEREAS, the apparent meaning of AS 29.23.130 (d) is
contrary to the express desire of the Borough electorate and th-
best interests of the professional administration of Borough
government.
NOW, THEREFORE, BE IT RESOLVED by the Assembly of the
Kodiak Island Borough that the current borough manager,
Stuart Denslow, shall continue to perform the duties and assume
the responsibilities of borough manager as set forth in applica•le
state law and as reflected in his employment contract notwith-
standing the apparent meaning of AS 29.23.130 (d).
BE IT FURTHER RESOLVED that should the law as set for h
in AS 29.23.130 (d) affect the legality of Stuart Denslow's
Resolution No. 77 -9 -R
appointment as borough manager, Mr. Denslow shall continue to
perform the duties and assume the responsibilities of borough
manager as a de facto borough manager with the attendant legal
limitations but without diminishing the practical scope of his
duties or his salary.
