RESOLUTION NUMBER 75 -37 -R
A RESOLUTION OF THE BOROUGH ASSEMBLY OF THE KODIAK
ISLAND BOROUGH PURSUANT TO CHAPTER 5, SUBCHAPTER 4, SECTION 6,
OF THE KODIAK ISLAND BOROUGH CODE OF ORDINANCES AND RESOLUTIONS,
APPROVING THE FINAL PLAT OF THE PSAGSHAK RIVER SUBDIVISION,
SECOND ADDITION, OF U. S. SURVEY 4970, KODIAK ALASKA.
WHEREAS, Chapter 5, Subchapter 4, Section 6 of the Kodiak Island
Borough Code of Ordinances and Resolutions provides that a final plat
shall be approved by the Borough Assembly by Resolution, which Resolution
shall provide for the acceptance of all street, alleys, and easements, and
other open spaces dedicated to public purposes and that JOE ZENTNER,
has presented for approval his final plat of the subdivision of that portion
of U. S. Survey 4970, Psagshak River Subdivision Second Addition, and
was approved by the Borough Assembly on September 4, 1975 with the
stipulation that the plat set forth a convenance stating that the Tots are
accessible only by sea or air, there is no land access, further that the deeds
will have the same statement and the grantees shall sign that they recognize
this and accept these provisions. And that the Tots are also subject to a
pedestrian easement of ten foot along the mean high water line along Psagshak
River and Psahshak Bay.
WHEREAS, the Planning and Zoning Commission of the Kodiak
Island Borough denied said final plat on June 25, 1975 and was taken to
the Borough Assembly for appeal and approved.
NOW, THEREFORE, BE IT RESOLVED that the Kodiak Island Borough
Assembly grant approval to this final plat presented by Joe Zentner,
prepared by Roy A. Ecklund, Registered Land Surveyor ( May 20, 1975)
and that all streets, alleys, easements, convenance, and other open
spaces shown on said plat be and the same are hereby dedicated to public
purposes and the asame are hereby accepted.
