RESOLUTION NUMBER 75 -35 -R
A RESOLUTION OF THE KODIAK ISLAND BOROUGH AUTHORIZING
THE BOROUGH ATTORNEY TO FILE PROTESTS AND INITIATE OTHER
ADMINISTRATIVE ACTIONS WITH REGARD TO LAND SELECTIONS UNDER
THE ALASKA NATIVE LAND CLAIMS ACT THAT CONFLICT WITH
BOROUGH INTERESTS.
WHEREAS, Village and Regional Corporations are in the process
of making selections under the Alaska Native Land Claims Act and submitting
those selections for approval by the Department of Interior; and,
WHEREAS, individual native residents have applied to the Department
of Interior for primary residence land allotments within the vicinity of
the Kodiak Island Borough, and,
WHEREAS, some of the selections made by the Corporations or
individuals may have adverse effect on the Kodiak Island Borough intervening
with third party interests created by the Borough, threatening the
availability of critical water sources or otherwise interfering with valid
municipal projects and purposes for which public funds have been expended;
and,
WHEREAS, protests to the selections or other administrative action
are necessary to advise the Interior Department of valid interests to be
affected by those selections and to advocate denial of approval to those
selections;
NOW THEREFORE, BE IT RESOLVED, by the Kodiak Island Borough
that the Borough Attorney is hereby directed to review and evaluate land
selections to the Kodiak Island Borough by village, Regional and special
corporations under the Alaska Native Land Claims Act and as primary
residence selections individuals and to file protests to those selections
or otherwise initiate administrative action before the Department of
Interior or any of its agencies to present and advocate the interests of
Kodiak Island Borough that will be adversely affected by approval of those
selections.
