A RESOLUTION AUTHORIZING THE EXCHANGE OF A PORTION OF PRIVATE
LAND, DESCRIBED AS LOT 18 U.S. SURVEY 3466, FOR A PORTION OF
KODIAK ISLAND BOROUGH -OWNED LAND, DESCRIBED AS
TRACT B U.S. SURVEY 3465, OF EQUIVALENT VALUE
(GENERALLY LOCATED ON THE BACK SIDE OF DARK LAKE)
WHEREAS, the Kodiak Island Borough has received a request to exchange a portion
of private land for portion of Borough real property; and
WHEREAS, Kodiak Island Borough Code 18.80 outlines the procedure used to
exchange Borough real property including the need for a best interest finding; and
WHEREAS, it is in the Borough's best interest to exchange parcels because the
property gained is an alternate route for a future public road that will serve a number
of lots that are not presently served by public access; and
WHEREAS, the land exchange meets the requirements of Section 18.80.020
Procedure of the Borough Code; and
WHEREAS, the Planning and Zoning Commission held a public hearing on this
request and recommends that the Assembly approve this request;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: The exchange of a portion of private land, described as Lot 18 U. S.
Survey 3466, for a portion of Borough land, described as Tract B U.S.
Survey 3465, being of equivalent value is hereby approved.
Section 2: Values of the properties to be exchanged shall be determined by the
Borough assessor or private appraiser.
Section 3: Evidence of marketable title for all properties involved in the transaction
shall be substantiated.

Section 4: The cost of survey, appraisals (if performed by private appraiser), title
search, and agreement preparation shall be borne by the applicant.
Section 5: The Kodiak Island Borough mayor, or his designee, is designated to
