A RESOLUTION GRANTING A DRIVEWAY ACCESS BY EASEMENT ACROSS
TRACT B U.S. SURVEY 3465 FOR THE BENEFIT OF LOT 18 U.S. SURVEY 3466,
LOT 2 U.S. SURVEY 3104, AND OTHER LAND - LOCKED PARCELS
LOCATED ON THE BACKSIDE OF ISLAND LAKE AND DARK LAKE.
WHEREAS, a driveway easement across Tract B, U.S. Survey 3465 provides access
to parcels that otherwise are not served by public roads, and
WHEREAS, this easement legitimizes the historical use of this Kodiak Island Borough
parcel; and
WHEREAS, the granting of the easement to provide access is consistent with the
Comprehensive Plan that identifies this area for residential uses, and
WHEREAS, the granting of the easement meets the requirements and intent of
Kodiak Island Borough Code Section 18.20.030 Review by the planning commission -
Assembly approval; and
WHEREAS, the Planning and Zoning Commission held a public hearing and
recommends that the Assembly approve this request.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
Section 1: That an access easement across Borough land described as Tract B,
U.S. Survey 3465, for the benefit of private properties on the backside
of Dark Lake and Island Lake within U.S. Surveys 3466 and 3104, is
hereby approved.
Section 2: The easement shall be terminated should the Borough construct a public
road serving these parcels.
Section 3: Any costs associated with entering into an easement agreement shall be
borne by the applicant.

Section 4: The Kodiak Island Borough mayor, or his designee, is designated to
negotiate all terms of the easement and sign all related documents.
