1996-25 Authorizing the Acquisition of the Subsurface Estate at the Salonie Creek Rifle Range.KODIAK ISLAND BOROUGH RESOLUTION NO. 96 -25 Introduced by: Mayor Selby Requested by: Resource Manager Drafted: Resource Manager Introduced: 09/05/96 Adopted: 09/05/96 A RESOLUTION AUTHORIZING THE ACQUISITION OF THE SUBSURFACE ESTATE AT THE SALONIE CREEK RIFLE RANGE WHEREAS, the Kodiak Island Borough purchased approximately 700 acres of land from Leisnoi, Inc. in 1991 that included the Salonie Creek Rifle Range; and WHEREAS, the rifle range has become an important public facility in which the citizens of the Borough may safely discharge firearms; and WHEREAS, the purchase of the rifle range in 1991 included only the surface estate of the parcel and not the subsurface (sand, gravel and other minerals) estate from Koniag, Inc.; and WHEREAS, the rights of the subsurface estate owner has become an issue around the state as the court system has ruled in favor of the subsurface owner in a number of cases; and WHEREAS, Koniag, Inc. and the Borough have held numerous discussions since 1991 about the value and rights of the subsurface owner; and WHEREAS, Koniag, Inc. and the Borough agreed to hire a single appraiser to determine the subsurface value; and WHEREAS, the appraisal has been reviewed by the assessor and resource manager and found to be satisfactory in content and analysis; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: The mayor is authorized, under KIBC 18.10.010 (H), to purchase the subsurface estate of the Salonie Creek Rifle Range from Koniag, Inc. for a sum not to exceed $68,800.
