1996-13 Approving Terms and Conditions for Sale of a Tax Foreclosed Property.KODIAK ISLAND BOROUGH RESOLUTION NO. 96 -13 Introduced by: Mayor Selby Requested by: Planning and Zoning Commission Drafted by: Resource Manager Introduced: 05/02/96 Adopted: 05/02/96 A RESOLUTION APPROVING THE TERMS AND CONDITIONS OF SALE OF A 1992 TAX FORECLOSURE PARCEL TO THE CONSERVATION FUND (TEN ACRE PARCEL LOCATED IN UYAK BAY) WHEREAS, the assembly approved Ordinance No. 95 -05 that declared certain tax foreclosed properties for "public purpose "; and WHEREAS, said ordinance directed the mayor to enter into negotiations for sale or trade of these parcels to the Kodiak National Wildlife Refuge for fair market value and that any proceeds of the sale, after payment of taxes and penalties owed the Borough, be distributed to the former owner; and WHEREAS, said ordinance reverted these parcels back to the Planning and Zoning Commission for further review, comment, and recommendation "on a site specific basis where the nature of the property, with respect to the value to the Kodiak Island Borough, the Refuge, or the general public "; and WHEREAS, Ordinance No. 95 -05 stated that prior to any sale or trade of the parcels, the terms of sale or trade are subject to approval by assembly resolution; and WHEREAS, the former owner has approached the Borough about disposing his parcel to the Conservation Fund and the Conservation Fund has agreed to purchase said parcel and convey it to the Kodiak National Wildlife Refuge; and WHEREAS, the Planning and Zoning Commission has reviewed this parcel at a public meeting and has made a recommendation to the assembly about the value of this parcel; and WHEREAS, the Borough and the Conservation Fund have agreed to language found in a "draft" document titled • - -•• - I NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: The assembly approves the sale of parcel TL 20 -02, located in Section 20, T31S,R28W S.M. (formerly owned by Carl Larsen Sr.), to the Conservation Fund for the purposes of subsistence, habitat protection, recreation, and other public values subject to the following conditions: Kodiak Island Borough, Alaska Resolution No. 96 -13 Page 1 of 2 1. The proceeds from the sale, subject to payment of back taxes and penalties to the Kodiak Island Borough, be returned to the former owner in accordance with AS29.45.480(b); 2. The sales price be based on the fair market value of the parcel as determined or approved by the Borough assessor; 3. That the parcel be conveyed to the Kodiak National Wildlife Refuge; 4. That the customary and traditional uses of wild and renewable resources found on the parcel and access to and on the parcel as guaranteed by the Alaska National Interest Lands Conservation Act (ANILCA) be preserved. Section 2: In accordance with KIBC 18.10.020, the mayor, or his designee, is authorized to sign all documents associated with this disposal.
