A RESOLUTION AUTHORIZING THE ACQUISITION OF AN EASEMENT ACROSS
PRIVATE PROPERTY AND AWARDING A CONTRACT FOR THE CONSTRUCTION
OF A BIKE AND PEDESTRIAN ACCESS TRAIL TO
NORTH STAR ELEMENTARY SCHOOL
WHEREAS, the construction of North Star Elementary School is completed and will
be in full operation starting January 2, 1996; and
WHEREAS, an access route is needed from the intersection of Anton Way and Lilly
Drive to provide safe passage to the school by children living in the Island Lake area
as well as those living on Balika Lane, Lilly Drive, and Eider Street; and
WHEREAS, because of topographic constraints and the need to construct a trail that
can be plowed during periods of snow and sanded during periods of ice, the most
practical route to locate this 500 foot trail requires the crossing of private property
for a distance of approximately 150 feet; and
WHEREAS, the property is owned by a contractor who is a licensed excavator
capable of performing trail construction; and
WHEREAS, the contractor has offered to grant an easement across his parcel in
return for the right to construct the trail;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that in accordance with the Kodiak Island Borough Code 18.10.020, the
mayor, or his designee, is authorized to acquire an easement across Lot 1, Block 9
Miller Point Subdivision, 1st Addition for a bike and pedestrian easement to provide
access to North Star Elementary School and to sign all necessary documents.
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE ASSEMBLY OF THE KODIAK
ISLAND BOROUGH that the assembly awards a sole source contract to Anderson
Construction of Kodiak, Alaska for the construction of a 500 foot long trail for a sum
not to exceed $18,250.
