(Along Egan Way).KODIAK ISLAND BOROUGH RESOLUTION NO. 95 -43 Introduced by: Mayor Selby Requested by: Planning and Zoning Commission Drafted by:Community Development Department Introduced: 11/02/95 Amended: 11/02/95 Adopted: 11/02/95 A RESOLUTION AUTHORIZING DISPOSAL OF 1,081 SQUARE FEET OF LOT 7B, U.S. SURVEY 2538A, TO THE CITY OF KODIAK FOR LESS THAN FAIR MARKET VALUE (ALONG EGAN WAY) WHEREAS, Kodiak Island Borough Code 18.20.100.B allows for property disposal for less than fair market value to any political subdivision of the state of Alaska; and WHEREAS, 1,081 square feet of land located within Lot 7B, U.S. Survey 2538A, has been requested by the city of Kodiak for essential access to Lot 6B -1 to allow for future subdivision; and WHEREAS, due to the odd shape and very narrow depth along Egan Way, this parcel is essentially unusable to the Borough in its present configuration, and is surplus to the Borough's needs; and WHEREAS, the Planning and Zoning Commission held a public hearing at their October 18, 1995 regular meeting on this disposal request; and WHEREAS, the Planning and Zoning Commission has recommended that the Kodiak Island Borough Assembly approve this disposal; and WHEREAS, Egan Way right -of -way is restricted by the northeast corner of Lot 6B- 1A; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT 1,081 square feet of land located within Lot 78, U.S. Survey 2538A, as indicated on the preliminary plat for PZC Case S95 -022 (copy attached), is determined to be surplus to the Borough's needs and is authorized for disposal to the city of Kodiak for less than fair market value in exchange for a portion of Lot 68- 1 A which is necessary to maintain the full width of the Egan Way right -of -way. The disposed parcel must be attached by plat to Lot 6B -1, U.S. Survey 2538A (proposed Lots 6B -1A and 6B -1B).
