1995-42 Authorizing the Acquisition of Tidelands for Recreation, Subsistence, and Safety Purposes in Anton Larsen Bay.KODIAK ISLAND BOROUGH RESOLUTION 95 -42 Introduced by: Mayor Selby Requested by: Resource Manager Drafted by: Resource Manager Introduced: 11/02/95 Adopted. 11/02/95 A RESOLUTION AUTHORIZING THE LEASE OF STATE TIDELANDS FOR RECREATION, SUBSISTENCE, AND SAFETY PURPOSES IN ANTON LARSEN BAY WHEREAS, in 1984, after the completion of the Terror Lake Hydroelectric Project, the Borough acquired a floating dock located in Anton Larsen Bay from the project contractor; and WHEREAS, this dock has become a popular facility providing access in and around Kupreanof Strait for recreation, subsistence for Kodiak residents, as well as for access to services in the city of Kodiak by the residents of Ouzinkie and Port Lions; and WHEREAS, in 1984 this dock was punctured below the waterline, sunk and became inoperative; and WHEREAS, permits from the state of Alaska and the U.S. Army Corps of Engineers were required, and survey and platting of the area was needed; and WHEREAS, because tidelands throughout the state of Alaska are owned by the state under the Submerged Lands Act, a lease of the tidelands from the state is also required; and WHEREAS, Kodiak Island Borough Code 18.10 sets out the procedure by which the borough can acquire interests in real property from other entities; and WHEREAS, KIBC 18.10 requires the passage of an assembly resolution to enter into a tidelands lease with the state of Alaska, and permits the acquisition of real property for specific purposes or project, without review by the planning and zoning commission; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT in accordance with KIBC 18.10, the mayor, or his designee, is authorized to enter into a lease with the state of Alaska for tidelands in Anton Larsen Bay surrounding the existing floating dock for maneuvering room, as well as for future parking areas for the site, and to sign all documents to affect said lease.
