A RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE LAND FOR
UTILITY EASEMENT PURPOSES (ACROSS LOT 11, U.S. SURVEY 3464)
WHEREAS, the assembly has approved construction of the North Star Elementary
School; and
WHEREAS, in conjunction with this project, a utility easement across private
property is needed to tie into existing public utilities; and
WHEREAS, it is necessary to obtain a permanent construction and maintenance
easement from the landowner to enter on this private parcel; and
WHEREAS, Kodiak Island Borough Code of Ordinances (KIBC) 18.10 sets out the
procedure by which the Borough can acquire real property; and
WHEREAS, KIBC 18.10.030 permits the acquisition of real property for specific
purpose or project, without review by the Planning and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: In accordance with KIBC 18.10.020, the mayor, or his designee, is
authorized to acquire, by fair market value, a utility easement across Lot 11, U.S.
Survey 3464.
Section 2: The mayor, or his designee, is authorized to sign all necessary
documents to affect said purchase.
