1995-04 Opposing An Increase in Utility System Development Fees by the City of Kodiak.KODIAK ISLAND BOROUGH RESOLUTION NO. 95 -04 Introduced by: Assembly Requested by: Assembly Drafted: Borough Clerk Introduced: 03/02/95 Adopted: 03/02/95 A RESOLUTION OPPOSING AN INCREASE IN UTILITY SYSTEM DEVELOPMENT FEES BY THE CITY OF KODIAK WHEREAS, the Assembly considers the construction of public and private facilities vital to the economic development of the borough; and WHEREAS, the Assembly of the Kodiak Island Borough and the Council of the City of Kodiak developed a list of the most significant and urgent projects to present to the governor and the nineteenth legislature, naming the Wastewater Treatment Plant modification as the number one top priority; and WHEREAS, increasing utility system development fees and charges limits the affordability of facilities; and WHEREAS, utility system development fees have doubled in less than two years; and WHEREAS, the City of Kodiak Council, by Resolution Number 05 -95, doubled the sewer connection fee at their February 23, 1995 regular meeting; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT an increase in utility system development fees is opposed, as unnecessary, untimely and detrimental to the Kodiak community. Smith, CMC, Borough Clerk Kodiak Island Borough, Alaska 2. i -i% 71.4..„,., M- -r . � -mi -♦ -- -- - Resolution No. 95 -04 Page 1 of 1 KODIAK ISLAND BOROUGH RESOLUTION NO. 95 -05 Introduced by: Mayor Selby Requested by: Mayor Selby Drafted by: Resource Management Officer Introduced: 03/16/95 Adopted: 03/16/95 A RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN TAX FORECLOSED PROPERTY FOR THE YEAR 1993 AND PRIOR YEARS WHEREAS, Alaska Statutes Title 29 and Kodiak Island Borough Code 3.20 set out the procedure in which to acquire private property due to the non payment of taxes; and WHEREAS, the action of foreclosure of private parcels is a very specific and legal process .taking up to two years to conclude requiring the acquisition of title reports and information on lien holders and others having interest in the land; and WHEREAS, record owners are notified monthly of their delinquent tax obligation. Record owners and others with interest in the property are additionally notified by certified letters of the pending foreclosure of property many times throughout the process. Names of delinquent property taxpayers are also published in the newspaper a total of eight (8) times during the two year process; and WHEREAS, all effort in this process is structured not to foreclose on the parcel, but to encourage property owners to meet their tax obligations as do all other property owners; and WHEREAS, KIBC 18.10.020 requires that tax foreclosed property be acquired by resolution of the Assembly; and WHEREAS, KIBC 18.10.030 states that tax foreclosed parcels acquired by Assembly resolution be reviewed by the Planning Commission. The Commission will determine which properties should be devoted to public use and which properties should be offered for disposal; and WHEREAS, such a determination by the Commission will be forwarded to the Mayor and Assembly prior to a final deposition decision by the Assembly: NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: In accordance with KIBC 18.10.010 the Assembly accepts the attached Kodiak Island Borough, Alaska Resolution No. 95 -05 Page 1 of 2 Section 2: In accordance with KIBC 18.10.020 the Assembly directs the Planning Commission to review the properties and make recommendations on the disposition of these parcels.
