A RESOLUTION APPROVING A LEASE OF KODIAK ISLAND BOROUGH REAL
PROPERTY AND SETTING THE TERM OF LEASE
WHEREAS, Kodiak Island Borough Resolution No. 94 -10 authorized the disposal by
lease, at fair market value, a portion of Lot 5B -1, U.S. Survey 2538A to
Island Communication, Inc. for telecommunications purposes; and
WHEREAS, upon submission and review of legal documents, Island Communication,
Inc. operating as Island Cable T.V. qualifies as a "public utility"
according to Kodiak Island Borough Code of Ordinances 18.40.020(B);
and
WHEREAS, under said code section, public utilities may qualify for a term of lease
"not to exceed twenty -five (25) years to a nonprofit corporation or public
utility at a reasonable rental rate taking into consideration the purpose
for which the real property is to be used ";
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: Approval, as submitted, of a lease of Borough real property to Island
Cable T.V.
Section 2: In accordance with Kodiak Island Borough Code of Ordinances
18.4O.020(B), the term of said lease shall not exceed twenty -five (25)
years.
