A RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTY
BY EASEMENT FOR DRAINAGE PURPOSES
(LOT 10, U.S. SURVEY 3464)
WHEREAS, Kodiak Island Borough Code (KIBC) 18.100 sets out the procedure by
which the Kodiak Island Borough can acquire real property; and
WHEREAS, KIBC 18.10.030 grants the borough assembly the authority to acquire
any real property for specific purposes with passage of a resolution; and
WHEREAS, the residents of the Kodiak Island Borough passed a bond issue to
construct a new elementary school; and
WHEREAS, during the construction of the Northstar Elementary School
approximately 12 acres of natural vegetation will be removed; and
WHEREAS, there is a need to consider the drainage aspects of the site created with
the removal of this vegetation; and
WHEREAS, the plan for drainage of the site requires the acquisition of a drainage
easement across an adjacent residential lot; and
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: In accordance with Kodiak Island Borough Code 18.10.020, the mayor,
or his designee, is authorized to enter into an agreement to acquire an
easement, for fair market value, for drainage purposes on Lot 10, U. S.
Survey 3464.
