A RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTY
BY EASEMENT FOR UTILITY PURPOSES
(LOT 1, BLOCK 56, EAST ADDITION)
WHEREAS, Kodiak Island Borough Code (KIBC) 18.100 sets out the procedure by
which the Kodiak Island Borough can acquire real property; and
WHEREAS, KIBC 18.10.030 grants the borough assembly the authority to acquire
any real property for specific purposes with passage of a resolution; and
WHEREAS, the residents of the Kodiak Island Borough passed a bond issue to
construct a new hospital; and
WHEREAS, the design for the utilities serving the new facility requires tying into an
existing waste water line located on an adjacent parcel that is in private
ownership; and
WHEREAS, a utility easement across the parcel is needed to legally tie into the
existing utilities;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: In accordance with Kodiak Island Borough Code 18.10.020, the mayor,
or his designee, is authorized to enter into an agreement to acquire an
easement, for fair market value, for utility purposes on Lot 1, Block 56,
East Addition.

Section 2: The borough mayor, or his designee, is authorized to sign all necessary
paperwork to affect said purchase.
