A RESOLUTION ESTABLISHING A KODIAK ISLAND BOROUGH
OIL SPILL RECOVERY FUND
WHEREAS, the Kodiak Island Borough and its residents sustained personal and
financial losses as a result of the 1989 Exxon Valdez oil spill; and
WHEREAS, the Kodiak Island Borough and its residents continue to suffer a
collective personal, economic and environmental loss because of the
Exxon Valdez oil spill; and
WHEREAS, the Kodiak Island Borough and its residents have discovered that their
way of life and means of earning a living have been forever altered; and
WHEREAS, the Kodiak Island Borough and its residents understand that every
member of the community, regardless of age, sex, ethnic background,
economic station, or occupation, has been adversely affected by the oil
spill;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: The Kodiak Island Borough and its residents support the establishment
of a Kodiak Island Borough oil spill recovery fund which will receive all
compensation to the community as a result of the oil spill litigation.
Section 2: The money in the Kodiak Island Borough oil spill recovery fund shall be
prudently invested for the benefit of helping the community recover from
the acute damage and lingering aftermath of the Exxon Valdez oil spill.
Section 3: Upon reimbursement to the Kodiak Island Borough for monies expended
on oil spill related activities, the remaining principal of the Kodiak Island
Borough oil spill recovery fund shall be left intact and used for delivery
of impacted services, such as mental health and hospital services,
economic development, education, and preservation of the environment,
which will either restore or replace economic damage from the spill and
shall only be withdrawn by a unanimous vote of the Assembly.

Section 4: The Kodiak Island Borough Assembly may use only the interest from the
Kodiak Island Borough oil spill recovery fund for oil spill recovery
activities and projects in the Kodiak Island Borough.
Section 5: The Kodiak Island Borough oil spill recovery fund shall be looked upon as
an investment upon which to build the future of the Kodiak Island
Borough and provide long term recovery from the impact of the Exxon
Valdez oil spill.
