1994-02 Accepting the Donation of Real Property for Neighborhood Park Purposes.Introduced by: Mayor Selby Requested by: Resource Manager Drafted by: Resource Manager Introduced: 01 /06/94 Adopted: 01 /06/94 KODIAK ISLAND BOROUGH RESOLUTION NO. 94-02 A RESOLUTION ACCEPTING THE DONATION OF REAL PROPERTY FOR NEIGHBORHOOD PARK PURPOSES WHEREAS, the Kodiak Island Borough Code of Ordinances (KIBC) 18.10 sets out the procedure by which the borough may acquire real property; and WHEREAS, KIBC 18.10.020 allows for the acquisition of real property by dedication, grants, or gifts with the passage of assembly resolution; and WHEREAS, the developers of Woodland Acres Seventh Addition, Kodiak, Alaska, have donated a parcel of land to the Kodiak Island Borough for the purposes of providing a neighborhood park; and WHEREAS, a restriction in the deed requires that the lot be developed into a neighborhood park within five years from the date of this instrument (1997) or said lot will revert to the grantors; and WHEREAS, there exists a crucial need for a park within this densely populated area in light of the fact that there is no public land in or adjacent to this subdivision; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: In accordance with Kodiak Island Borough Code of Ordinances 18.10.20, the Assembly formally accepts the donation of real property legally described as Lot 12, Block 11, Woodland Acres Subdivision, Seventh Addition, Kodiak, Alaska. Section 2: The acquisition of said parcel is for the purpose of developing a neighborhood park.
