A RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTY
BY EASEMENT FOR RIGHT -OF -WAY PURPOSES
WHEREAS, Kodiak Island Borough Code of Ordinances (KIBC) 18.10 sets out the
procedure by which the borough can acquire real property; and
WHEREAS, KIBC 18.10.030 allows the assembly to acquire any real property for
specific purposes with passage of a resolution; and
WHEREAS, the roadway of Viewcrest Lane encroaches upon a privately owned lot,
legally described as Lot 8B Crestview Subdivision; and
WHEREAS, the cost of relocating the road into the right -of -way was determined by
an outside engineer to be S85,000 as compared to purchasing an
easement for S3,500; and
WHEREAS, the roadway is stable and relocating the roadway would cause
substantial reconfiguration and design to bring the roadway up to
borough code; and
WHEREAS, relocating the roadway would create a defined safety concern with a
sharp turn at the bottom of a downgrade and a ten -foot drop -off on the
downhill side; and
WHEREAS, after review of the property by the Service District No. 1 chairman and
the borough engineering /facilities director, the recommendation is to
acquire the private property by easement for right -of -way purposes;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH:
Section 1: In accordance with KIBC 18.10.020, the mayor or his designee is
authorized to enter into an agreement to purchase an easement for right -
of -way of a 1,676 square foot portion of Lot 86 Crestview Subdivision.

Section 2: The borough mayor or his designee is authorized to sign all necessary
documents to effect said purchase.
