1992-33 Authorizing the Disposal by Sale of Borough Property, a Portion of Lot 5A-1, U.S. Survey 2538, for Less than Full Market Value to the Kodiak Public Broadcasting CorporationIntroduced by: Requested by: Drafted byCommunity Introduced: Amended: Adopted: KODIAK ISLAND BOROUGH RESOLUTION NO. 92 -33 Mayor Selby Assembly Development Department 08/06/92 08/06/92 08/06/92 A RESOLUTION AUTHORIZING THE DISPOSAL BY SALE OF BOROUGH PROPERTY, A PORTION OF LOT 5A -1, U.S. SURVEY 2538, FOR LESS THAN FULL MARKET VALUE TO THE KODIAK PUBLIC BROADCASTING CORPORATION (GENERALLY LOCATED OFF EGAN WAY) WHEREAS, Kodiak Island Borough Code 18.20.030 requires the review of each disposal of borough real property by the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission, with the adoption of Resolution No. 90 -02, recommended that the assembly dispose of the subject property to the Kodiak Public Broadcasting Corporation for less than fair market value, having determined that the disposal was consistent with KIBC 17 and KIBC 18; and WHEREAS, the Kodiak Island Borough Assembly has already authorized, with the adoption of Resolution No. 90 -61, the disposal of Lot 5A -1, for less than fair market value to the Kodiak Public Broadcasting Corporation; NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: Lot 5A -1 shall be disposed of in fee simple to the Kodiak Public Broadcasting Corporation for a price of $5,000. The deed shall contain the following clause: "Should the property cease to be used for the p of providing p, ubI c radio cervices, the parcel will revert back to the Kodiak Island Borough" or a clause to this effect.
