A RESOLUTION A THORIZING THE ACQUISITION OF A RIGHT - -OF -WAY PERMIT
FROM THE S • TE OF ALASKA FOR THE PASAGSHAK RIVER BRIDGE
WHEREAS, landowners the Pasagshak Subdivision 2nd Addition are without
practical acce . to this forty -four (44) lot subdivision; and
WHEREAS, a number of lando ners have organized and intend to construct a private
bridge, at their exp- se, across the Pasagshak River; and
WHEREAS, the Department of Fis & Game has set a time limit in which to
construct the bridge (Ma 15, 1992 to June 30, 1992) based on the
presence of salmon in the ver; and
WHEREAS, the State of Alaska will issue - . rivate access permit to the landowners
but must go through a proces that will prevent construction of the
bridge this season; and
WHEREAS, the owners of lots in the subdivision desire to limit access across the
bridge to landowners who participate monetarily in the bridge
construction; and
WHEREAS, the developers are routing access to the bri..e across private property
to limit access to those individuals who hav entered into an access
agreement with the private property owne and contributed to
construction of the bridge; and
WHEREAS, the Kodiak Island Borough will incur liability associat:d with defects in
the design, construction, and maintenance of the bridge y accepting the
right -of -way permit; and
WHEREAC the Kodiak Island Borough is willing to accept this liability b passing it
along to individuals and /or corporations involved in bridge con truction;
and

WHERE the Kodiak Island Borough supports construction of a bridge that
provides access to landowners in the subdivision knowing that the
concept of a bridge has been reviewed by various public entities and not
nstructed;
NOW, THEREFO , BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:

Section 2: The Kodiak Islan,o Borough will require information by individuals and /or
corporations who construct and maintain the bridge naming the Borough
as additional insure. to protect against any liability for personal injury or
property damage bot during the bridge construction and thereafter.
