1992-21 Authorizing Disposal of Borough Land.KODIAK ISLAND BOROUGH RESOLUTION NO. 92 -21 Introduced by: Mayor Selby Requested by: Mayor Selby Drafted by: Community Development Department Introduced: 06/04/92 Adopted: 06/04/92 A RESOLUTION AUTHORIZING THE DISPOSAL OF BOROUGH LAND, FOR LESS THAN FULL MARKET VALUE, TO THE KODIAK ELKS LODGE FOR THE PURPOSE OF DEVELOPING A YOUTH CAMP AND LODGE. PROPOSED LOT 1A -2 TRACT A, U.S. SURVEY 3465 (APPROXIMATELY 3.35 ACRES) GENERALLY LOCATED ON THE SOUTH SHORE OF ISLAND LAKE WHEREAS, the Kodiak Elks Lodge has had a long history of use of this site for scouting and youth purposes; and WHEREAS, the Kodiak Elks Lodge has a current lease for the property valid until 2008; and WHEREAS, the Kodiak Elks Lodge has started construction of a scout and youth lodge on the property; and WHEREAS, the Kodiak Elks Lodge has requested ownership of the property in order to use it as collateral, in order to expedite completion of the scout and youth lodge; and WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has reviewed the disposal request and has recommended that the Kodiak Island Borough Assembly approve the request subject to four (4) conditions. NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: The Borough Mayor is authorized to dispose of proposed Lot 1A -2, Tract A, U.S. Survey 3465 (approximately 3.35 acres), for less than full market value, subject to the following conditions: Kodiak Island Borough, Alaska Resolution No. 92 -21 Page 1 of 2 Section 1: Section 2: Section 3: Section 4: ATTEST: (---) Borough Clerk The existing dirt road will be retained for public pedestrian and bike riding access; and A restriction will be placed on the deed specifying that the land disposed of shall only be used for scouting and youth purposes; and A restriction will be placed on the deed that, should the property no longer be utilized for it's intended purposes, the title will revert to the Borough; and A restriction will be placed on the deed limiting the removal of trees, brush and other vegetation on the site. Only vegetation that is diseased, threatening to damage a main structure, or which must be removed to increase security of the site, or to provide trail access to the lake may be removed.
