A RESOLUTION DISPOSING OF A 579 SQUARE FOOT PORTION AND A
890 SQUARE FOOT PORTION OF THE MAIN ELEMENTARY SCHOOL SITE
TO BE USED AS PART OF THE MILL BAY ROAD RECONSTRUCTION PROJECT
(PORTIONS OF TRACT C, U.S. SURVEY 2538B) (GENERALLY LOCATED AT THE
CORNER OF POWELL AVENUE AND MILL BAY ROAD)
WHEREAS, the City of Kodiak has requested that the Kodiak Island Borough dispose
of two portions of Tract C, U.S. Survey 2538B to be used as part of the
Mill Bay Road reconstruction project; and
WHEREAS, the disposal is consistent with the general intent of the comprehensive
plan, which designates the area for public and open space, by being used
for a public project that will benefit the entire community when it is
completed; and
WHEREAS, the property requested by the City of Kodiak consists of one (1) 579
square foot portion and one (1) 890 square foot portion of the larger
tract; and
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission has
recommended disposal of the parcel at fair market value, subject to one
condition;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: the Borough Mayor is authorized to dispose of one (1) 579 square foot
portion and (1) 890 square foot portion of Tract C, U.S. Survey 2538B
for fair market value subject to the condition that the proposed
conveyances shall be replatted within one (1) year of the transfer of
ownership.
