RESOLUTION NO. 92 -03
A RESOLUTION AUTHORIZING THE ACQUISITION OF A UTILITY EASEMENT
LOCATED ON PRIVATE PROPERTY BY EMINENT DOMAIN
(PORTION OF U.S. SURVEY 2843) (BAPTIST MISSION PROPERTY)
WHEREAS, Service District No. 1 Project 86 -2 would replace existing public water
and sewer lines along the east boundary of U.S. Survey 2843; and
WHEREAS, these existing public utility lines fail, frequently increasing maintenance
costs and presenting a health and safety hazard to adjoining properties
and the public; and
WHEREAS, State of Alaska regulations now require a ten (10) foot horizontal
separation when installing public water and sewer lines; and
WHEREAS, a value of $3,650.40 has been determined to be the fair market value
of a 22'x234' (5,148 square foot) utility easement; and
WHEREAS, negotiations have stalled between the Kodiak Island Borough and the
Kodiak Baptist Mission to acquire the additional land necessary to replace
the failing utility lines; and
WHEREAS, the Kodiak Island Borough Engineering /Facilities Department has
examined a number of alternatives and have determined that the option
proposed would cause the greatest public benefit at the least private
injury; and
WHEREAS, the Service District No. 1 Board of Supervisors, at their December 7,
1991 meeting, voted unanimously to recommend to the Kodiak Island
Borough Assembly that the property needed to effectuate this project be

NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: A 5,124 square foot utility easement along the east boundary of U.S.
Survey 2843 be acquired by eminent domain at fair market value in
accordance with Kodiak Island Borough Code Section 18.10.020.
Section 2: The Mayor of the Kodiak Island Borough, or his designee, is authorized
to proceed with the process of eminent domain and to sign all
documents associated with said acquisition.
