A RESOLUTION OF THE KODIAK ISLAND BOROUGH AUTHORIZING
THE DISPOSAL BY EASEMENT OF BOROUGH PROPERTY
TO THE KODIAK ELECTRIC ASSOCIATION, FOR LESS THAN
FAIR MARKET VALUE, TO BE USED FOR AN ABOVE
GROUND ELECTRICAL LINE
WHEREAS, Section 18.20.030A of the Borough Code requires the review of each
disposal of Borough real property by the Planning and Zoning
Commission; and
WHEREAS, Section 18.20.170 of the Borough Code defines "disposal" as any
transfer of real property; and
WHEREAS, Section 18.20.100B allows for property disposal at less than fair market
value to a non-profit association upon a finding that the disposal will
allow the use of the land for a public purpose beneficial to the Borough;
and
WHEREAS, the Planning and Zoning Commission has held an advertised and noticed
public meeting on the disposal; and
WHEREAS, the Planning and Zoning Commission has determined that this proposal
is consistent with the Borough Code, specifically Title 17 (Zoning) and
the Kodiak Island Borough Coastal Management Program; and
WHEREAS, the Planning and Zoning Commission has determined that it would be
appropriate to dispose of a partial Borough interest in this property in
order to improve electrical service to the Island Lake area; and
WHEREAS, the Planning and Zoning Commission recommended that two conditions
be placed on the disposal of this property.

NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH TO:
Authorize the disposal of a partial interest in real property to the Kodiak
Electric Association through the granting of an easement 550 feet in
length and 20 feet in width on Lot 1A, U.S. Survey 3465, at less than
fair market value in accordance with Kodiak Island Borough Code Section
18.20.100B, subject to the following conditions:
1. Electrical line installation shall be subject to the performance
standards contained in Section 17.10.050 of the Borough Code; and
2. The Kodiak Electric Association shall plat an as -build survey of the
easement granted.
PASSED AND APPROVED THIS 3rd DAY OF OCTOBER, 1991.
